The letter urges the EU executive to take action, thorough investigations and possible punitive measures, on &#8220;serious and persistent violations&#8221; of what the EU Treaties provide &#8211; from a surveillance scandal to government interference in the media to an &#8220;overall unsafe&#8221; working environment and a criminal justice system used to threaten civil society groups and activists: <strong>i<\/strong><strong>ncluding the suspension of disbursement of EU funds.<\/strong><\/p>\n<figure id=\"attachment_178155\" class=\"wp-caption alignright\" style=\"width: 450px;\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/07\/1657015023654_20220705_EP-134330C_FMA_PBU_027_MOBILE.jpeg\"><img decoding=\"async\" class=\"wp-image-178155\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/07\/1657015023654_20220705_EP-134330C_FMA_PBU_027_MOBILE-300x200.jpeg\" alt=\"Kyriakos Mitsotakis Grecia\" width=\"450\" height=\"300\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/07\/1657015023654_20220705_EP-134330C_FMA_PBU_027_MOBILE-300x200.jpeg 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/07\/1657015023654_20220705_EP-134330C_FMA_PBU_027_MOBILE.jpeg 768w\" sizes=\"(max-width: 450px) 100vw, 450px\" \/><\/a><figcaption id=\"caption-attachment-178155\" class=\"wp-caption-text\">Greek Prime Mininster Kyriakos Mitsotakis<\/figcaption><\/figure>\n<p>As the <a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/02\/Joint-NGO-letter-to-EC-on-Greece-RoL-EMB-until-6-February1.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a> of the 17 organizations &#8211; including the European Federation of Journalists, Human Rights Watch, Greek Council for Refugees, and Reporters sans fronti\u00e8res &#8211; notes, for the last two consecutive years Athens has ranked last of the EU Member States (107 out of 180 countries overall) in the <a href=\"https:\/\/rsf.org\/en\/country\/greece\" target=\"_blank\" rel=\"noopener\">World Press Freedom Index<\/a>, while in the <a href=\"https:\/\/commission.europa.eu\/document\/download\/10bc40c8-b6f5-4ad4-8bde-b2ee4df33680_en?filename=21_1_52575_coun_chap_greece_en.pdf\" target=\"_blank\" rel=\"noopener\">Chapter on Greece<\/a> of the 2023 Report on the Rule of Law in Europe, the EU Commission expressed concern about the situation of journalists and civil society. However, &#8220;we regret that neither the report nor the Commission\u2019s related statements on Greece reflect the severity of the situation,&#8221; the signatories wrote, referring, in particular, to <strong>&#8220;smear campaigns&#8221; and &#8220;threats and attacks, and the misuse of the criminal law&#8221; against defenders of migrant rights<\/strong>\u00a0&#8220;to a shocking degree.&#8221;<\/p>\n<p>In addition, there is\u00a0the scandal of the use of state espionage and surveillance systems of journalists, which &#8220;raises <strong>urgent privacy and free expression concerns<\/strong> and affects the ability of the press to hold authorities to account.&#8221; Although in May 2023, the EU Parliament&#8217;s Special Inquiry Committee to Examine the Use of Pegasus and Other Spyware (Pega) indicated to the government led by conservative <strong>Kyriakos Mitsotakis<\/strong> the need to strengthen institutional and legal safeguards and independent oversight mechanisms, the authorities in Athens instead took &#8220;<strong>different measures to deliberately reduce levels of transparency and oversight<\/strong>,&#8221; thereby limiting the options for redress for surveillance victims.<\/p>\n<figure id=\"attachment_207818\" class=\"wp-caption alignright\" style=\"width: 452px;\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-scaled.jpg\"><img decoding=\"async\" class=\"wp-image-207818\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-300x200.jpg\" alt=\"Grecia von der Leyen Mitsotakis\" width=\"452\" height=\"301\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-300x200.jpg 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-1024x683.jpg 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-768x512.jpg 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-1536x1024.jpg 1536w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/09\/P061791-873671-2048x1366.jpg 2048w\" sizes=\"(max-width: 452px) 100vw, 452px\" \/><\/a><\/figure>\n<p>From left: Greek Prime Minister Kyriakos Mitsotakis and EU Commission President Ursula von der Leyen<\/p>\n<p>Although national security remains the responsibility of the Member States, the EU Commission &#8220;cannot continue to turn a blind eye when surveillance can lead to abuses of EU law,&#8221;\u00a0the 17 organizations warn on the &#8220;<strong>violations and maladministration in the implementation of EU law<\/strong>&#8221; in Greece. That is why they are urging the EU executive not only to &#8220;thoroughly investigate&#8221; but to obtain &#8220;clear and effective corrective action, openly, and publicly&#8221; from the Greek authorities &#8212; to be included with a &#8220;clear, detailed, and comprehensive&#8221; picture of the Rule of Law 2024 report &#8212; but above all to carry out <strong>an &#8220;accurate and impartial&#8221; assessment of cases where violations could trigger the &#8220;suspension of EU funds to the country.&#8221;<\/strong><\/p>\n<div class=\"page\" title=\"Page 3\">\n<h3 id='the-use-of-spyware-in-greece'  id=\"boomdevs_1\">The use of spyware in Greece<\/h3>\n<p>As of August 2022, the ruling New Democracy party is accused of using spyware against members of civil society, journalists, and political opponents, <strong>including MEP and Pasok leader, Nikos Androulakis<\/strong>. Androulakis revealed that it all began when European Parliament President <strong>Roberta Metsola <\/strong>decided to react decisively to the CatalanGate scandal involving five Catalan independence MEPs. Since then, the European Parliament services have allowed all MEPs who request it to examine their smartphones to detect spyware. Androulakis used this service in late June as a precautionary measure, and from the <strong>first check, a link related to Predator spyware<\/strong>, developed in Israel, was detected.<\/p>\n<p><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/03\/Spyware-Pegasus.jpeg\"><img decoding=\"async\" class=\" wp-image-170994 alignright\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/03\/Spyware-Pegasus-268x300.jpeg\" alt=\"Spyware Pegasus\" width=\"500\" height=\"560\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/03\/Spyware-Pegasus-268x300.jpeg 268w, https:\/\/www.eunews.it\/wp-content\/uploads\/2022\/03\/Spyware-Pegasus.jpeg 687w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a>As with the Pegasus spyware &#8211; which has so far involved the governments of Poland, Hungary, and Spain &#8211; Predator, at the center of what MEPs \u00a0define as &#8220;Greece&#8217;s WaterGate,&#8221; <strong>exploits flaws in smartphone software to collect information,\u00a0<\/strong>such as conversations, emails, messages, photos, and videos,<strong> about a user&#8217;s online activities without their consent.<\/strong>\u00a0 Spyware\u00a0also allows turning devices into audio and video recorders for real-time surveillance.
