Negotiators from the EU Parliament and Council failed today (Feb. 6)\u00a0to sign\u00a0<a href=\"https:\/\/www.eunews.it\/en\/2024\/02\/05\/rape-based-on-consent-eu-agreement\/\" target=\"_blank\" rel=\"noopener\">a historic deal<\/a> to harmonize at the EU level a <strong>definition of rape based on the lack of\u00a0consent<\/strong>. After five rounds of negotiations,<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20240205IPR17411\/violence-against-women-press-conference-on-tuesday-at-18-00\" target=\"_blank\" rel=\"noopener\">\u00a0there is an agreement<\/a>, but without including rape, defined based\u00a0of lack\u00a0of consent, among crimes in the\u00a0EU.\u00a0<\/span><span style=\"font-weight: 400;\">It is from Strasbourg, where the European Parliament Plenary is underway, that negotiators announced that they\u00a0reached a political understanding on the <\/span><strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52022PC0105\" target=\"_blank\" rel=\"noopener\">proposal for\u00a0a\u00a0directive on combating gender-based violence<\/a><\/strong><span style=\"font-weight: 400;\">, put forward by the European Commission on Mar. 8, 2022, with the idea of criminalizing several\u00a0crimes, including female genital mutilation, online violence, and rape, defined in Article 5 as &#8220;any compulsion to a non-consensual sexual act.&#8221;<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-o-mail-quote-node=\"1\" data-o-mail-quote=\"1\">\n<p dir=\"ltr\" lang=\"en\">Deal!<\/p>\n<p>We have an agreement on combating <a href=\"https:\/\/twitter.com\/hashtag\/ViolenceAgainstWomen?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">#ViolenceAgainstWomen<\/a> and domestic violence.<\/p>\n<p>For the first time ever, we criminalise wide-spread forms of <a href=\"https:\/\/twitter.com\/hashtag\/cyberviolence?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">#cyberviolence<\/a>, such as non-consensual sharing of intimate images.<\/p>\n<p>Thank you <a href=\"https:\/\/twitter.com\/FitzgeraldFrncs?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@FitzgeraldFrncs<\/a> <a href=\"https:\/\/twitter.com\/EvinIncir?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@EvinIncir<\/a> and <a href=\"https:\/\/twitter.com\/EU2024BE?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@EU2024BE<\/a> <a href=\"https:\/\/t.co\/PNPrY7aYNc\">pic.twitter.com\/PNPrY7aYNc<\/a><\/p>\n<p>&#8211; V\u011bra Jourov\u00e1 (@VeraJourova) <a href=\"https:\/\/twitter.com\/VeraJourova\/status\/1754919269110862169?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">February 6, 2024<\/a><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">At present, member states do not have a shared definition of rape based on the absence of consent, although they consider it a crime inscribed in the Criminal Code, the definition of which is not the same in all countries. The agreement reached between co-legislators stipulates does not mention rape among EU crimes but mentions it <strong>in Article 36,<\/strong>\u00a0which regards prevention whereby Member states only commit &#8220;to raising awareness that non-consensual sex is considered a crime,&#8221; explains a note from the European Parliament.<\/span>\u00a0\u00a0The two rapporteurs for the European Parliament &#8211; Swedish MEP\u00a0<strong>Evin Incir (S&amp;D)<\/strong>\u00a0and Irish MEP\u00a0<strong>Frances Fitzgerald (EPP) &#8212;\u00a0<\/strong>expressed<strong>\u00a0&#8220;<\/strong>Great disappointment&#8221; at a brief press conference in Strasbourg organized immediately after the announcement of the agreement. The Commission&#8217;s proposal envisaged the offense, and Parliament confirmed it. However, it did not pass due to deadlock in the EU Council, where it was impossible to reach the necessary qualified majority.<span style=\"font-weight: 400;\"> <strong>&#8220;13 member states,&#8221; including Italy, supported the proposal<\/strong>, the rapporteurs said, as in negotiations they\u00a0pushed for an opening through Article 36 toward the concept of prevention of the\u00a0crime. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;We hope it will lead to the development of a culture based on consensus,&#8221; they said,\u00a0confiding that\u00a0thanks to the &#8220;review clause requiring the Commission to evaluate the implementation of the directive within the next 5 years,&#8221; something might change. <strong>France and Germany, like Austria and the Netherlands,<\/strong> are the big countries contrary to\u00a0such a specific European definition of rape, complaining that there is no legal basis for these new rules.<\/span><\/p>\n<p>The EU\u00a0<strong>estimates that one in three women have experienced physical or sexual violence<\/strong> in their lifetime, mostly perpetrated by intimate partners, and\u00a0<strong>one in two women have experienced sexual harassment.<\/strong> During the COVID-19 pandemic, which forced months and years of restrictions on people&#8217;s free movement by making them spend more time at home, there was a significant\u00a0increase in physical and emotional violence against women. Since the Internet and social media have taken over our lives, online violence has also become a rising trend. Despite the downshifted agreement,\u00a0it is still a step forward in EU legislation. The directive introduces EU-wide rules <strong>on the criminalization of certain forms of gender-based violence<\/strong> and improved access to justice, protection, and prevention. It will include a longer list of aggravating circumstances for crimes, including crimes against public figures, journalists, or human rights defenders; intent to punish victims because of their sexual orientation, gender, color, religion, social origin, or political beliefs; and intent to preserve or restore &#8220;honor.&#8221; Rules against female genital mutilation and specific rules for online crimes, including dissemination of intimate material and cyberflashing, will be introduced.
