{"id":341987,"date":"2024-03-04T14:50:37","date_gmt":"2024-03-04T13:50:37","guid":{"rendered":"https:\/\/www.eunews.it\/2024\/03\/04\/apple-multa-ue-streaming-musicale\/"},"modified":"2024-03-07T19:06:37","modified_gmt":"2024-03-07T18:06:37","slug":"eu-fines-apple-1-8-billion-for-abuse-of-dominant-position-in-music-streaming-market","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2024\/03\/04\/eu-fines-apple-1-8-billion-for-abuse-of-dominant-position-in-music-streaming-market\/","title":{"rendered":"EU fines Apple 1.8 billion for abuse of dominant position in music streaming market"},"content":{"rendered":"<p>Brussels &#8211; Three years after opening a formal complaint against Apple over possible abuse of a dominant market position in the music streaming market, the European Commission opted for the harshest decision yet.\u00a0<strong>A 1.8 billion euro fine, to be paid for practices that are &#8220;illegal under EU antitrust rules,&#8221;\u00a0<\/strong>through which the Cupertino company restricted third-party developers from informing consumers about alternative and cheaper music subscription services available outside the Apple ecosystem.<\/p>\n<p>EU Commission Vice-President for Digital and Commissioner for Competition <strong>Margrethe Vestager<\/strong>\u00a0<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_24_1161\" target=\"_blank\" rel=\"noopener\">announced<\/a> the fine\u00a0against the U.S.-based multinational technology company\u00a0at a specially convened press conference today (March 4).\u00a0 After three years of investigation and assessment, the Commission confirmed the concerns that emerged in the spring of 2021 about specific violations regarding\u00a0<em>anti-steering<\/em>\u00a0provisions &#8212; those measures designed to prevent an app from redirecting the user to an external online store. In other words,\u00a0<strong>Apple made it nearly impossible for iOS users (of iPhones and iPads) to learn about and subscribe to music streaming apps outside the App Store<\/strong>\u00a0or indirectly imposed higher fees.<\/p>\n<figure id=\"attachment_341951\" class=\"wp-caption alignright\" style=\"width: 449px;\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-scaled.jpg\"><img decoding=\"async\" class=\"wp-image-341951\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-300x200.jpg\" alt=\"Margrethe Vestager\" width=\"449\" height=\"299\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-300x200.jpg 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-1024x683.jpg 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-768x512.jpg 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-1536x1024.jpg 1536w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-2048x1366.jpg 2048w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-750x500.jpg 750w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/03\/P063265-160368-1140x760.jpg 1140w\" sizes=\"(max-width: 449px) 100vw, 449px\" \/><\/a><figcaption id=\"caption-attachment-341951\" class=\"wp-caption-text\">EU Commission Vice-President for Digital and Commissioner for Competition, Margrethe Vestager<\/figcaption><\/figure>\n<p>The Commission noted that Apple is currently the sole provider of the App Store, where developers can distribute their apps to iOS users throughout the European Economic Area (EEA), and &#8220;<span style=\"font-size: medium;\">c<\/span>ontrols every aspect of the iOS user experience and sets the terms and conditions that developers need to abide by&#8221; to reach users in the App Store. <strong>The <em>anti-steering<\/em> provisions prohibit third-party app developers from informing iOS users within their apps about the prices of subscription offers available on the Internet<\/strong>, as well as price differences between in-app subscriptions. The ban is also on including links that lead iOS users to the app developer&#8217;s website and the ability for the developers to contact their newly acquired users.<\/p>\n<p>&#8220;These anti-steering provisions are\u00a0<strong>neither necessary nor proportionate<\/strong>\u00a0for the protection of Apple&#8217;s commercial interest and &#8220;<strong>negatively affect the interests of iOS users<\/strong>, who cannot make informed and effective decisions&#8221; about music streaming apps to use on their device. In practical terms, this means that <strong>&#8220;for almost ten years&#8221; iOS users may have been paying &#8220;significantly higher&#8221; prices because of the high fees imposed by Apple<\/strong> <strong>to developers<\/strong> and passed on to the end consumer in the form of higher subscription prices. Added to this is the <strong>non-monetary damage<\/strong> &#8220;in the form of a degraded user experience,&#8221; since iOS users had to perform a &#8220;cumbersome&#8221; search before finding the desired offering, &#8220;or they\u00a0never subscribed to any service because they did not find the right one on their own.&#8221;<\/p>\n<p>Taking into account the duration and severity of the infringement, the total turnover, and the fact that &#8220;incorrect information was provided in the administrative procedure,&#8221; the European Commission imposed a fine of 1.8 billion euros, <strong>&#8220;proportionate to Apple&#8217;s global revenues and is necessary to achieve deterrence.&#8221;<\/strong> As the Commission points out, this is a lump sum fine, made necessary because &#8220;a significant part of the harm caused by the infringement consists of non-monetary harm, which cannot be adequately accounted for under the revenue-based methodology.&#8221; In addition, the U.S. company was ordered to\u00a0<strong>remove the <em>anti-steering<\/em> provisions and to &#8220;refrain from repeating the infringement <\/strong>or from adopting practices with an equivalent object or effect in the future.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The European Commission found restrictions on app developers, who were banned from informing iOS users about &#8220;alternative and cheaper&#8221; subscription services available outside the Apple Store.
