After the <a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/12\/funds-to-hungary-eu-parliament-is-serious-juri-committee-backs-court-action-against-eu-executive\/\" target=\"_blank\" rel=\"noopener\">recommendation<\/a> to take\u00a0the case to the Court formulated by the European Parliament&#8217;s Juri Committee, President<strong>\u00a0Roberta Metsola<\/strong> informed the chairs of the political groups today (March 14) that\u00a0<strong>she will instruct the institution&#8217;s legal services to take\u00a0the case to the Court in Luxembourg<\/strong> on behalf of the Parliament by the March 25\u00a0judicial deadline.<\/p>\n<p>According to<a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/RULES-9-2020-02-03-RULE-149_EN.html\" target=\"_blank\" rel=\"noopener\">\u00a0Article 149<\/a> of the Rules of Procedure, the European Parliament can\u00a0refer natural and legal persons to the European Court of Justice to ensure compliance with the Treaties. Under scrutiny\u00a0is\u00a0<strong>the legal basis of the Commission&#8217;s unilateral decision<\/strong>\u00a0to\u00a0unfreeze\u00a0cohesion funds for Hungary on December 13.<\/p>\n<p>Within hours of the European Council\u00a0giving the green light to open accession negotiations for Ukraine and Moldova, the EU executive announced that it would unfreeze some of the cohesion policy, fisheries, and home affairs funds previously blocked pending Budapest&#8217;s implementation of reforms to improve the rule of law. In return, <strong>Orban gave up getting in the way of opening accession negotiations with Ukraine<\/strong> and Moldova.<\/p>\n<p>The European Commission&#8217;s response came immediately, in the words of Christian Wigand, spokesman for rule of law issues. The EU executive &#8220;considers that it has <strong>acted in full compliance with EU law<\/strong> and will defend its decision before the Court&#8221;, he said. Wigand emphasised that &#8220;<strong>Hungary had submitted all the evidence required<\/strong> to show the independence of its judiciary&#8221;, that&#8217;s why the Commission found Budapest&#8217;s &#8220;partial compliance with the horizontal enabling conditions&#8221; necessary for the release of funds. This being the case, Wigand concluded that &#8220;the Commission is bound by strict timelines and conditions set out in EU legislation&#8221; and &#8220;therefore had a legal obligation to adopt a decision&#8221;.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Metsola informed group leaders that she will refer the case to the European Court of Justice by March 25.
