{"id":360351,"date":"2024-05-13T11:47:48","date_gmt":"2024-05-13T09:47:48","guid":{"rendered":"https:\/\/www.eunews.it\/2024\/05\/13\/modifica-pac-via-libera-consiglio-ue\/"},"modified":"2024-05-16T15:34:32","modified_gmt":"2024-05-16T13:34:32","slug":"changes-to-the-common-agricultural-policy-may-be-applicable-by-farmers-as-early-as-2024","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2024\/05\/13\/changes-to-the-common-agricultural-policy-may-be-applicable-by-farmers-as-early-as-2024\/","title":{"rendered":"Changes to the Common Agricultural Policy may be applicable by farmers as early as 2024"},"content":{"rendered":"<p>Brussels &#8211; From the proposal to the final green light in less than two months:\u00a0that&#8217;s almost a record for the amendment to the Common Agricultural Policy (CAP), which, after <a href=\"https:\/\/www.eunews.it\/en\/2024\/04\/24\/eu-parliament-puts-a-new-seal-on-the-amendment-of-the-common-agricultural-policy\/\" target=\"_blank\" rel=\"noopener\">approval by the urgent procedure in the\u00a0plenary session of the EU Parliament<\/a>, received the final green light this morning (May 13) from the EU Council by written procedure. <a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/26\/eu-council-gives-green-light-to-cap-amendment-amid-fresh-protests-from-farmers\/\" target=\"_blank\" rel=\"noopener\">Unlike in late March<\/a>\u00a0after the first approval from the 27 Agricultural Ministers, this time there were no protests from farmers outside the EU institution, &#8211; but the seal came smoothly on the <a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/15\/eu-commissions-proposals-to-change-the-common-agricultural-policy-and-ease-some-burdens\/\" target=\"_blank\" rel=\"noopener\">proposals made by\u00a0the EU Commission<\/a>\u00a0on\u00a0March 15 to\u00a0<strong>address problems encountered in the implementation of the strategic plans of the CAP<\/strong>.<\/p>\n<p>After months of <a href=\"https:\/\/www.eunews.it\/en\/2024\/02\/26\/farmers-set-fire-to-the-european-quarter-in-brussels\/\" target=\"_blank\" rel=\"noopener\">harsh protests<\/a> in member states and Brussels -particularly earlier this year &#8211; the amendment to the CAP followed an accelerated process in Brussels, and now only co-legislators of the Parliament and the Council have to sign the\u00a0law. <strong>The entry into force will come the day after publication in the EU Official Journal, &#8220;by the end of May,&#8221;\u00a0the Council<\/strong> <a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2024\/05\/13\/council-gives-final-green-light-to-a-targeted-review-of-the-common-agricultural-policy\/\" target=\"_blank\" rel=\"noopener\">said.<\/a>\u00a0European farmers will\u00a0be able to apply some of the new environmental cross-compliance rules <strong>retroactively to 2024<\/strong>, <a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/19\/commissioner-wojciechowski-wants-the-effects-of-pac-changes-to-be-felt-as-early-as-2024\/\" target=\"_blank\" rel=\"noopener\">as already urgently requested<\/a>\u00a0by the head of Agriculture in the von der Leyen cabinet, <strong>Janusz Wojciechowski<\/strong>.<\/p>\n<p>After the <a href=\"https:\/\/www.eunews.it\/en\/2024\/02\/13\/brussels-adopts-waiver-on-uncultivated-cap-land-through-2024\/\" target=\"_blank\" rel=\"noopener\">temporary waiver through 2024 to uncultivated land,<\/a> the revised CAP plans to <strong>completely<\/strong>\u00a0<strong>eliminate\u00a0 the allocation of &#8220;a minimum proportion of arable land to non-productive areas&#8221;\u00a0<\/strong>from standard 8 of &#8216;Good Agricultural and Environmental Conditions&#8217; (GAEC) &#8211; that is, fallow land &#8211; &#8220;while maintaining the protection of existing landscape elements.&#8221; <strong>Member states will\u00a0instead be required to establish an eco-scheme to\u00a0support farmers<\/strong>\u00a0in\u00a0maintaining a portion of arable land in a non-productive state or to create new landscape elements (such as hedges or trees). Farmers will be rewarded for these non-productive areas beneficial to biodiversity on farmland and, more generally, rural areas.<\/p>\n<p><strong>The 27 Member States\u00a0will also be able to provide specific exemptions<\/strong> from rules\u00a0on GAEC\u00a0standards 5, 6, and 7 (tillage management, ground cover, and fallow land) <strong>for situations that are likely to be contrary to their objectives<\/strong>, such as in the case of specific soil and subsoil conditions. More specifically, <strong>crop rotation<\/strong> (standard 7) will be retained\u00a0but <strong>with the\u00a0option of meeting this requirement with crop diversification<\/strong>.\u00a0This should give farmers affected by regular drought or excessive rainfall the flexibility to meet the condition in a more compatible way with agricultural realities.<\/p>\n<p>Among the most significant changes is the <strong>exemption for farms under 10 hectares from cross-compliance checks and penalties<\/strong>, affecting 65 percent of CAP beneficiaries but only 10 percent of the total agricultural area. <strong>The aim is to alleviate the administrative burden associated with controls, which is higher for small farms than larger ones<\/strong>. In other words &#8212; in addition to the general flexibilities of the GAEC\u00a0&#8212;\u00a0 the relief in the burden for small farmers with a maximum farm size of no more than 10 hectares of agricultural area will ensure that <strong>they do not have to be audited for compliance with statutory management requirements<\/strong>, since the exemption would not significantly hinder the role of cross-compliance requirements in contributing to climate and environmental objectives. In addition, there is also the proposal\u00a0to <strong>increase the number of requests to amend the CAP&#8217;s Strategic Plan\u00a0from one to two per year<\/strong>.<\/p>\n<p>Regarding farmers&#8217; remuneration and their position in the food supply chain, three paths will be followed:\u00a0first, the Commission will launch an\u00a0<strong>observatory of production costs, margins, and business practices in the agrifood supply chain<\/strong> &#8211; with representatives of all sectors of the food supply chain and representatives of the member states and the Commission. Secondly, there will be a\u00a0<strong>strengthening of the rules applicable to contracts that farmers enter into with the food industry or retail buyers<\/strong> through new options to the Regulation establishing a Common Market Organization for Agricultural Products (CMO) and cross-border enforcement of rules against unfair trade practices. Finally, the Commission will conduct\u00a0<strong>a thorough evaluation of the Directive on Unfair Trade Practices in the Food Supply Chain<\/strong> in force since 2021, with the first report due in the spring of 2024 and a more detailed evaluation to be presented in 2025 along with legislative proposals &#8220;if appropriate.&#8221;<\/p>\n<div class=\"flourish-embed\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Measures proposed by the EU Commission to reduce burdens on farmers, including several derogations from &#8216;Good Agricultural and Environmental Conditions&#8217; (GAEC), receive the latest green light from the EU Council.
