{"id":381231,"date":"2024-07-29T12:49:33","date_gmt":"2024-07-29T10:49:33","guid":{"rendered":"https:\/\/www.eunews.it\/2024\/07\/29\/corte-giustizia-ue-reddito-cittadinanza\/"},"modified":"2024-08-07T13:52:44","modified_gmt":"2024-08-07T11:52:44","slug":"basic-income-court-of-justice-italy","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2024\/07\/29\/basic-income-court-of-justice-italy\/","title":{"rendered":"Court of Justice rejects discrimination against third-country nationals in Italy&#8217;s citizenship basic income"},"content":{"rendered":"<p>Brussels &#8211; There is no peace for the former citizenship basic income: the subsidy introduced by the the government of the 5 Star Movement, abolished in\u00a0January 2024 by the executive led by Giorgia Meloni, <strong>applied discriminatory requirements against third-country nationals<\/strong>\u00a0who were long-term residents in Italy, according to a <a href=\"https:\/\/curia.europa.eu\/jcms\/jcms\/Jo2_7052\/\" target=\"_blank\" rel=\"noopener\">ruling<\/a> of the Court of Justice of the EU, thus ending a dispute between Rome and two foreign nationals.<\/p>\n<p>The two women were\u00a0accused of falsifying applications to receive\u00a0the basic\u00a0income, attesting that they met the requirement of <strong>residing in Italy for at least ten years, the last two of which continuously<\/strong>. In this way, they allegedly unduly received a sum of just over 3,000 euros each. The Naples court turned to the courts in Luxembourg to shed light on the residency requirement of the basic\u00a0income and its compliance with the European directive on long-term resident third-country nationals.<\/p>\n<p>The<a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2003\/109\/oj\" target=\"_blank\" rel=\"noopener\"> directive<\/a> dates back to 2003 and provides <strong>a condition of legal and continuous residence of five years<\/strong> in a Member State for a third-country national to be granted long-term resident status. This\u00a0period is considered sufficient to entitle\u00a0equal treatment with the nationals of that Member State, in particular, for social security, social assistance, and social protection.<\/p>\n<p>According to the EU Court of Justice, it\u00a0is &#8220;indirect discrimination&#8221; against non-EU nationals. The ruling is clear:\u00a0<strong>a member state &#8220;may not unilaterally extend the period of residence<\/strong>&#8221; required by the European directive so that a third-country national can\u00a0enjoy equal treatment with nationals of that member state. In addition, the court ruled that Italy cannot penalize the two women for a false declaration regarding a residency requirement that violates EU law.<\/p>\n<p>However, Brussels also criticizes the new Inclusion Allowance, which the Meloni government used to replace the Conte government&#8217;s flagship measure. In its annual <a href=\"https:\/\/www.eunews.it\/en\/2024\/05\/08\/the-eu-takes-a-snapshot-of-the-italy-of-the-poor-precarious-and-uneducated-flunks-the-inclusion-allowance\/\" target=\"_blank\" rel=\"noopener\">analysis<\/a> on social convergence, published in May, the European Commission predicted that the Meloni reform would result in &#8220;<strong>a higher incidence of absolute and child poverty<\/strong> (by 0.8 percentage points and 0.5 percentage points, respectively) than under the previous scheme.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>For the Luxembourg judges, the requirement to have resided in Italy for at least 10 years was not in accordance with European standards.
