Europe&#8217;s pioneering framework for innovative and safe AI<\/strong>,&#8221; European Commission\u00a0president <strong>Ursula von der Leyen<\/strong> announced\u00a0in a <a href=\"https:\/\/x.com\/vonderleyen\/status\/1818907654921535707\" target=\"_blank\" rel=\"noopener\">post<\/a> on X, emphasizing the importance of the news: &#8220;It will drive AI development that Europeans can trust. And provide support to European SMEs and startups to bring cutting-edge AI solutions to market.&#8221;<\/p>\n<p><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52.png\"><img decoding=\"async\" class=\" wp-image-282585 alignright\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-300x199.png\" alt=\"Intelligenza Artificiale\" width=\"449\" height=\"298\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-300x199.png 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-1024x681.png 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-768x511.png 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-750x499.png 750w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52-1140x758.png 1140w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/12\/Schermata-2023-12-11-alle-10.04.52.png 1164w\" sizes=\"(max-width: 449px) 100vw, 449px\" \/><\/a>Social Democrats in the European Parliament are also jubilant, <a href=\"https:\/\/x.com\/PES_PSE\/status\/1818905249119178802\" target=\"_blank\" rel=\"noopener\">thanking<\/a> the co-rapporteur for the EU Act on AI and former Democratic Party delegation leader, <strong>Brando Benifei<\/strong>, for the work done in the last legislature: &#8220;Unacceptable practices of artificial intelligence will be banned in Europe and the rights of workers and citizens will be protected,&#8221; including through &#8220;human control and its responsible use.&#8221; As Benifei confirmed in an\u00a0<a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/15\/benifei-after-ai-act-a-directive-on-artificial-intelligence-in-the-workplace-for-stringent-obligations\/\" target=\"_blank\" rel=\"noopener\">interview<\/a>\u00a0with\u00a0<em>Eunews<\/em> after the <a href=\"https:\/\/www.eunews.it\/en\/2024\/03\/13\/innovation-transparency-and-risk-eu-act-on-artificial-intelligence-passes-european-parliament-vote\/\" target=\"_blank\" rel=\"noopener\">almost unanimous approval<\/a> of the text by MEPs in the plenary session on\u00a0March 13, <strong>further legislative work on even more specific aspects<\/strong>, like its use in the workplace, may be set up in the 10th legislature of the EU Parliament. &#8220;We Europeans have always advocated an approach that puts people and their rights at the center of everything we do,&#8221; von der Leyen assures in launching the new EU Regulation today, &#8220;<strong>We create new stakes, not only to protect people and their interests but also to give businesses and innovators clear rules and certainty<\/strong>.&#8221;<\/p>\n<p>At this point, the focus is on the dates: The new legislation will be fully applicable in 24 months, meaning that <strong>by August 2, 2026, all member countries will have to comply with the provisions, with some exceptions<\/strong>. For bans on prohibited practices, implementation will already be triggered after six\u00a0months, for codes of conduct after nine, and for general AI rules (including governance) after 12. Obligations for high-risk systems will be delayed for another year, with implementation after 36 months. In the meantime, <strong>considering the timing of the entry into force of the new Regulation and the potential impact of new technologies that will continue to develop<\/strong>, the EU pact on artificial intelligence was launched in mid-November 2023\u00a0to voluntarily anticipate the AI requirements\u00a0and facilitate\u00a0the transition to the application of the new rules.<\/p>\n<h3 id='the-risk-scale-of-artificial-intelligence'  id=\"boomdevs_1\">The risk scale of artificial intelligence<\/h3>\n<p style=\"margin-bottom: 0px;\">The EU Regulation provides a horizontal level of user protection, with <strong>a four-level\u00a0risk scale to regulate artificial intelligence applications<\/strong>: minimal, limited, high, and unacceptable. There will be very light transparency requirements for systems with limited risk, like disclosing that content is AI-generated. <strong>For those with high risk, there will be a pre-market fundamental rights impact assessment<\/strong>, including a requirement to register with an ad-hoc\u00a0EU database and requirements on the data and technical documentation to be submitted to demonstrate product compliance.<\/p>\n<p style=\"margin-bottom: 0px;\">The Regulation places at an\u00a0<strong>unacceptable<\/strong> level&#8211;and therefore bans it &#8212; cognitive behavior manipulation systems,\u00a0<strong>untargeted collection of facial images from the Internet or CCTV footage<\/strong> to create facial recognition databases, emotion recognition in the workplace and educational institutions, &#8216;social scoring&#8217; by governments, <strong>biometric categorization to infer sensitive data<\/strong> (political, religious, philosophical beliefs, sexual orientation) or religious beliefs, and some instances of predictive policing for individuals.<\/p>\n<h3 id='exceptions-governance-and-foundation-models'  id=\"boomdevs_2\">Exceptions, governance and foundation models<\/h3>\n<figure id=\"attachment_194353\" aria-describedby=\"caption-attachment-194353\" style=\"width: 451px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21.png\"><img decoding=\"async\" class=\"wp-image-194353\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21-300x247.png\" alt=\"Artificial Intelligence ChatGPT EU\" width=\"451\" height=\"371\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21-300x247.png 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21-1024x842.png 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21-768x631.png 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/02\/Schermata-2023-02-17-alle-09.42.21.png 1382w\" sizes=\"(max-width: 451px) 100vw, 451px\" \/><\/a><figcaption id=\"caption-attachment-194353\" class=\"wp-caption-text\">Image created by an artificial intelligence following the instructions &#8220;robot making a speech at the EU Parliament&#8221;<\/figcaption><\/figure>\n<p style=\"margin-bottom: 0px;\">The Regulation includes an\u00a0<span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\"><strong>emergency procedure\u00a0that will allow law enforcement to use a high-risk artificial intelligence tool that has failed the evaluation procedure<\/strong>, which will have to dialogue on the protection of fundamental rights with the specific mechanism. There are also exemptions for <strong>the use of real-time remote biometric identification systems in publicly accessible spaces<\/strong>, subject to judicial authorization and for strictly defined lists of offenses.\u00a0 There may only be &#8216;ost-remote&#8217; use for the targeted search of a person convicted of or suspected of committing a serious crime.\u00a0Real-time use, &#8220;limited in time and place,&#8221; can be used for <\/span><strong>targeted searches of victims<\/strong> (kidnapping, trafficking, sexual exploitation), <strong>prevention of a &#8220;specific and current&#8221; terrorist threat,<\/strong> and for locating or identifying a person suspected of committing specific crimes (terrorism, human trafficking, sexual exploitation, murder, kidnapping, rape, armed robbery, participation in a criminal organization, environmental crimes).<\/p>\n<p>Among the new arrangements already in place is the <a href=\"https:\/\/www.eunews.it\/en\/2024\/01\/24\/brussels-office-created-to-coordinate-european-policies-on-artificial-intelligence\/\" target=\"_blank\" rel=\"_blank noopener\">ad-hoc AI office<\/a>\u00a0within the European Commission to <strong>supervise general-purpose artificial intelligence systems integrated into other high-risk systems<\/strong>, flanked by an advisory forum for stakeholders (representatives from industry, SMEs, start-ups, civil society, and academia). To account for the wide range of tasks that artificial intelligence systems can perform &#8211; generation of video, text, images, side-language conversation, computation, or computer code generation &#8211; and the rapid expansion of their capabilities, <strong>the<\/strong> <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\"><strong>&#8216;high-impact&#8217;\u00a0<\/strong>foundation models (a type of generative artificial intelligence trained on a broad spectrum of generalized, label-free data) <\/span><strong>will have to comply with several\u00a0transparency requirements before being\u00a0released to the market,<\/strong>\u00a0from drafting technical documentation to complying with EU copyright law to disseminating detailed summaries of the content used for training.<\/p>\n<h3 id='innovation-and-sanctions'  id=\"boomdevs_3\">Innovation and Sanctions<\/h3>\n<figure id=\"attachment_198518\" class=\"wp-caption alignright\" style=\"width: 400px;\">\n<p><figure id=\"attachment_198518\" aria-describedby=\"caption-attachment-198518\" style=\"width: 400px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06.png\"><img decoding=\"async\" class=\"wp-image-198518\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06-300x297.png\" alt=\"Artificial Intelligence Privacy\" width=\"400\" height=\"396\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06-300x297.png 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06-150x150.png 150w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06-768x760.png 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2023\/04\/Schermata-2023-04-14-alle-10.15.06.png 928w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><figcaption id=\"caption-attachment-198518\" class=\"wp-caption-text\">Image created by an artificial intelligence following the instructions &#8220;robot protecting online privacy&#8221;<\/figcaption><\/figure><\/figure>\n<p>To support innovation, <em>sandboxes<\/em> (test environments in computing) of artificial intelligence regulation will allow the creation of a controlled environment to\u00a0develop, test, and validate innovative systems even under real-world conditions. To <strong>alleviate the administrative burden for\u00a0smaller companies and protect them from the pressures of dominant market players<\/strong>, the Regulation provides &#8220;limited and clearly specified&#8221; support actions and exemptions.<\/p>\n<p style=\"margin-bottom: 0px;\">Finally, regarding sanctions, any <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">natural or leg may file a complaint with the relevant market supervisory authority regarding non-compliance with the EU Artificial Intelligence Act. <\/span>In the event of a violation of the Regulation,\u00a0<strong>the company will have to pay either a percentage of annual global turnover in the previous financial year or a predetermined amount (whichever is higher)<\/strong>: 35 million euros or 7 percent for violations of prohibited applications, 15 million euros or 3 percent for breaches\u00a0of the law&#8217;s obligations, 7.5 million euros or 1.5 percent for providing incorrect information.
