Today&#8217;s&nbsp;<span style=\"margin: 0px;padding: 0px\"><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=290687&amp;pageIndex=0&amp;doclang=EN&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=4050091\" target=\"_blank\" rel=\"noopener\">ruling&nbsp;<\/a><strong>excludes<\/strong><\/span><strong>&nbsp;the need for member states to consider other elements<\/strong> since, in Afghanistan, discriminatory measures against women are sufficiently severe to confirm the risk of &#8220;suffering persecution&#8221; by returning to the country of origin.&nbsp;<\/p>\n<p>The CJEU ruled after a <strong>preliminary reference from the Austrian Supreme Administrative Court<\/strong>, to which&nbsp;<span style=\"margin: 0px;padding: 0px\">two&nbsp;<strong>Afghan women had submitted the case<\/strong><\/span>&nbsp;after being refused refugee status by Austrian authorities. Legally speaking, through the preliminary reference, national courts request an opinion from the CJEU, which they must comply with when adjudicating the matter. In essence, it is up to the EU to decide.&nbsp;<\/p>\n<p>The legal basis for granting refugee status in the EU is <strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32011L0095\" target=\"_blank\" rel=\"noopener\">Directive 2011\/95\/EU<\/a><\/strong> (referring to the 1951 Geneva Convention relating to the Status of Refugees). A &#8220;<strong>refugee<\/strong>&#8221; is defined as a third-country national who is at risk of <strong>being persecuted for any discriminatory element<\/strong>, including &#8220;<strong>belonging to a particular social group<\/strong>,&#8221; as in the case of <strong>Afghani women.<\/strong> In addition to the well-founded evidence to prove the risks of return to the country of origin, the directive adds that <strong>having already received persecution or severe harm constitutes a valid reason to consider the fear of return to the country of origin<\/strong>.\n<\/p>\n<h4 id='background'  id=\"boomdevs_1\">Background<\/h4>\n<p style=\"margin-bottom: 0px\">\nThe <strong>return to power of the Taliban regime in 2021<\/strong> has involved <strong>severe violations of women&#8217;s rights<\/strong>. Discriminatory measures imposed range from the <strong>deprivation of any legal protection<\/strong> against <strong>gender and domestic violence,<\/strong>&nbsp;against <strong>forced marriage<\/strong>, <a href=\"https:\/\/www.eunews.it\/en\/2024\/08\/26\/brussels-condemns-talibans-law-prohibiting-afghan-womens-public-expression\/\" target=\"_blank\" rel=\"noopener\">prohibition of public speaking out<\/a>, limiting access to education, employment and politics, lack of access to health care and absence of freedom of movement, and not least, the obligation to cover one&#8217;s body and face completely.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\">The <strong>European Union had already sanctioned<\/strong>, on human rights issues, two interim Taliban ministers for higher education and the propagation of virtue and prevention of vice, advocates for bans on education and gender segregation practices in public spaces in Afghanistan. Similarly, there was <strong>great outrage over the August decree<\/strong> regarding the <strong>prohibition of expression<\/strong> and <strong>public display<\/strong> for women. In a <a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2024\/08\/26\/afghanistan-statement-of-the-high-representative-on-behalf-of-the-eu-on-latest-restrictions-imposed-by-the-taliban-on-the-people\/?utm_source=brevo&amp;utm_campaign=AUTOMATED%20-%20Alert%20-%20Newsletter&amp;utm_medium=email&amp;utm_id=320\" target=\"_blank\" rel=\"noopener\">note<\/a>, the <strong>High Representative of the EU for Foreign Policy, Joseph Borrell<\/strong>, commented, saying, &#8220;The recent decision represents another <strong>hard blow to the rights of Afghan women and girls<\/strong>: we cannot tolerate it.&#8221;\n<\/p>\n<h4 id='the-cjue-s-impactful-ruling'  id=\"boomdevs_2\">The CJUE&#8217;s impactful ruling<\/h4>\n<p style=\"margin-bottom: 0px\">\nThese elements are indicators of a <strong>social context in which the figure of women and their rights are nullified<\/strong>. Today&#8217;s CJUE ruling leaves no doubt: the measures against women in Afghanistan are real violations of fundamental rights.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\">&#8220;<strong>These measures<\/strong>, taken together, affect women in such a way that they reach the level of severity required to constitute acts of persecution,&#8221; the court says, and altogether &#8220;<strong>lead to the flagrant and dogged denial<\/strong> to Afghan women, on account of their sex alone, of fundamental rights related to human dignity.&#8221; One of the examples is forced marriage, which is &#8220;tantamount to a form of slavery,&#8221; or even <em>laissez-faire<\/em> to domestic and sexual violence, which are forms of inhuman and degrading treatment.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\">In its analysis of the granting of <strong>refugee status<\/strong> under international law, the CJUE noted the <strong>risky conditions for the safety of Afghan women should they return to the Taliban regime<\/strong>, also considering reports prepared by the European Union Asylum Agency (EUA) and the United Nations High Commissioner for Refugees (UNHCR).&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\">The CJEU decided<span style=\"margin: 0px;padding: 0px\">&nbsp;that Afghan protection seekers<strong>&nbsp;need not<\/strong><\/span><strong>&nbsp;prove &#8220;that the latter is actually and specifically at risk of being subjected to acts of persecution<\/strong> in the event of a return to her country of origin, if elements relating to her individual situation, such as <strong>nationality<\/strong> <strong>or<\/strong> <strong>sex<\/strong>, are <strong>demonstrated<\/strong>.&#8221;
