{"id":397232,"date":"2024-10-14T14:47:45","date_gmt":"2024-10-14T12:47:45","guid":{"rendered":"https:\/\/www.eunews.it\/2024\/10\/14\/carenze-stato-di-diritto-report-liberties\/"},"modified":"2024-10-17T16:13:55","modified_gmt":"2024-10-17T14:13:55","slug":"commissions-unwarranted-optimism-about-rule-of-law-alarms-human-rights-experts","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2024\/10\/14\/commissions-unwarranted-optimism-about-rule-of-law-alarms-human-rights-experts\/","title":{"rendered":"Commission&#8217;s unwarranted optimism about rule of law alarms human rights experts"},"content":{"rendered":"<p>Brussels &#8211; The rule of law continues to cause concern in the European Union, just as\u00a0<strong>the remarks in the European Commission&#8217;s Rule of Law 2024<\/strong> report that\u00a0&#8220;still presents <strong>significant shortcomings<\/strong>, despite the Commission&#8217;s triumphalist rhetoric,&#8221; <strong>according to\u00a0the Civil Liberties Union of Europe (<a href=\"https:\/\/www.liberties.eu\/en\/about\/organisation\" target=\"_blank\" rel=\"noopener\">Liberties<\/a>)<\/strong>.<\/p>\n<p><span style=\"text-align: center;\">Liberties has <\/span><a style=\"text-align: center;\" href=\"https:\/\/dq4n3btxmr8c9.cloudfront.net\/files\/_adyxi\/Gap_Analysis_EC_Rule_of_Law_Report_By_Liberties.pdf\" target=\"_blank\" rel=\"noopener\">analyzed<\/a>\u00a0<span style=\"text-align: center;\">the <\/span><a style=\"text-align: center;\" href=\"https:\/\/commission.europa.eu\/publications\/2024-rule-law-report-communication-and-country-chapters_en\" target=\"_blank\" rel=\"noopener\">Commission&#8217;s report<\/a>\u00a0<span style=\"text-align: center;\">to highlight the shortcomings in the analysis of the situation of European countries, considering the extensive network of contacts present in eighteen of them.<\/span><\/p>\n<p>The Commission claims that <a href=\"https:\/\/www.eunews.it\/en\/2024\/07\/24\/rule-of-law-eu-italy-slovakia-hungary\/\" target=\"_blank\" rel=\"noopener\">&#8220;68 percent <\/a>of the\u00a02023<strong>\u00a0Rule of Law Report&#8221;<\/strong>\u00a0recommendations were followed up by Member States. Unfortunately,\u00a0<strong>the reality that Liberties shows is of an overly confident Commission <\/strong>about\u00a0reform announcements or ongoing changes, going ahead and &#8220;attributing progress where there is little or none.&#8221; The outlook is less rosy, <strong>with 19 percent of recommendations actually implemented or followed through<\/strong>. Moreover, when the Commission speaks of &#8216;<strong>significant progress,<\/strong>&#8216; it does so without <strong>a precise definition,<\/strong> resulting in arbitrary attributions or <strong>forgetting significant shortcomings in some states<\/strong>. An example reported by Liberties is &#8220;the<a href=\"https:\/\/www.do.se\/om-do\/pressrum\/aktuellt\/2024\/2024-01-18-sakerhetszoner-innebar-oacceptabla-risker-for-diskriminering\" target=\"_blank\" rel=\"noopener\"> recent legislation passed by the Swedish government<\/a> violating fundamental rights,&#8221; referring to &#8220;more stringent criminal measures, including stop-and-search frisk zones, stay-away\u00a0orders, and the expanded use of secret surveillance measures.&#8221;<\/p>\n<h3 id='recommendations-are-not-implemented-and-results-difficult-to-measure'  id=\"boomdevs_1\">Recommendations are not implemented (and results difficult to measure)<\/h3>\n<p style=\"margin-bottom: 0px;\">Specifically, the report highlights the &#8220;Need for effective <strong>enforcement of the Commission&#8217;s recommendations<\/strong>.&#8221; In countries where a\u00a0<strong>continued decrease in the overall rule of law has been observed<\/strong> (including Hungary and Poland),\u00a0the Commission\u2019s recommendations <strong>were either completely disregarded or only partially implemented<\/strong>. Furthermore, the beacons of European democracy, such as Austria, France, or Germany, &#8220;which do not register a decline in the rule of law in general,&#8221; are not cooperative since they tend to pay little heed to the warnings of the institution chaired by von der Leyen.<\/p>\n<p style=\"margin-bottom: 0px;\">Another problem noted by human rights observers is that <strong>European recommendations are difficult to assess and measure<\/strong>. Therefore, &#8220;if they (recommendations, ed.) assign specific tasks to specific actors and set time limits,&#8221; they can serve as benchmarks for national reforms and policies. We need to have less &#8220;diplomatic considerations&#8221; and more severity when there are serious violations,\u00a0Liberties says.<\/p>\n<h3 id='lacking-enforcement-mechanisms'  id=\"boomdevs_2\">Lacking enforcement mechanisms<\/h3>\n<p style=\"margin-bottom: 0px;\">Submitting a rule of law report means having a <strong>representation of how the internal situation in\u00a0states is evolving. However, &#8220;it is a monitoring mechanism, not an enforcement tool.&#8221;<\/strong><\/p>\n<p>In addition to having the carrot of nearly 70 percent success (attributed very generously), it is necessary\u00a0to have a stick. And for that, according to Liberties, &#8220;the Commission <strong>must integrate the Annual Rule of Law Report into the broader EU rule of law toolkit,<\/strong> including the Article 7 procedure, infringement procedures, and budgetary conditionality.&#8221;<\/p>\n<p style=\"margin-bottom: 0px;\">Failure to comply with the recommendations should lead to concrete consequences. <strong>The proceedings<\/strong> listed are all among the\u00a0t<strong>ools to ensure the implementation of EU law<\/strong>. Infringement proceedings are initiated against states if there is a violation of EU law, while <strong>budgetary conditionality<\/strong> specifically aims at rule of law violations. The <strong>procedure of Article 7<\/strong> is the suspension clause (also called the &#8220;<strong>nuclear option<\/strong> &#8220;because of its severity), by which EU membership rights can be terminated for a state guilty of serious and persistent violations of EU principles.<\/p>\n<p style=\"margin-bottom: 0px;\">The second von der Leyen Commission should have more pulse in coordinating the detection of problems and sanctions to address them. There seems to be<strong>\u00a0more openness to listening to criticism<\/strong>, such as the implementation of sanctions, which is also mentioned in the<a href=\"https:\/\/commission.europa.eu\/document\/download\/907fd6b6-0474-47d7-99da-47007ca30d02_en?filename=Mission%20letter%20-%20McGRATH.pdf\" target=\"_blank\" rel=\"noopener\">\u00a0mission letter<\/a> to Commissioner-designate for Democracy, Justice and Rule of Law Michael McGrath.<\/p>\n<p style=\"margin-bottom: 0px;\">\u00a0&#8220;I<strong>t is imperative that the Commission takes swift and decisive action<\/strong>&#8221; to have concrete and decisive action for the Union. <strong> <a href=\"https:\/\/www.eunews.it\/en\/2024\/09\/19\/rule-of-law-illustrated-by-christoph-niemann-commission-launches-social-campaign-to-raise-awareness\/\" target=\"_blank\" rel=\"noopener\">Awareness campaigns<\/a>\u00a0and short-sighted, complacent observation of the (few) successes are\u00a0not enough:<\/strong> the EU needs to change and prevent member states from finding loopholes not to solve problems with the rule of law and, as a consequence, with respect for the founding values of the European Union. &#8220;The <strong>rule of law is being systematically dismantled<\/strong> by some governments, and the next commission needs to do better,&#8221; <strong>Viktor Kazai, a rule of law expert at Liberties<\/strong>, told the\u00a0<a href=\"https:\/\/www.theguardian.com\/world\/2024\/oct\/14\/european-audit-of-democracy-standards-too-positive-says-human-rights-watchdog\" target=\"_blank\" rel=\"noopener\">Guardian<\/a>. &#8220;It has been 14 years since the beginning of the rule of law crisis. We cannot wait: what happened in Hungary cannot happen in Slovakia,&#8221; he warned.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Little implementation of recommendations, many changes needed to improve.
