This was the ruling\u00a0by the judges of the immigration section of the Court of Rome, even though the Territorial Commissions had already rejected their asylum claims.<\/p>\n<p>The 12 asylum seekers from Egypt and Bangladesh had been rescued on the night of Oct. 13 by the Guardia di Finanza (Finance Police) in international waters of the Italian Sar zone and then transported to Albania by a navy ship to be interned in the Giader detention centre.\u00a0<a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55.jpeg\"><img decoding=\"async\" class=\"alignleft size-medium wp-image-398723\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-280x300.jpeg\" width=\"280\" height=\"300\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-280x300.jpeg 280w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-955x1024.jpeg 955w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-768x823.jpeg 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-750x804.jpeg 750w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55-1140x1222.jpeg 1140w, https:\/\/www.eunews.it\/wp-content\/uploads\/2024\/10\/WhatsApp-Image-2024-10-18-at-15.56.55.jpeg 1197w\" sizes=\"(max-width: 280px) 100vw, 280px\" \/><\/a>The Roman magistrates&#8217; decision applies an Oct. 4 ruling by the European Court of Justice that states that for a country to be considered &#8220;safe&#8221;, it must be so in every part and for every person; Egypt and Bangladesh, (Countries to which migrants could be returned) to the ruling&#8217;s criteria, are not.<\/p>\n<p>The President of the Chamber of the Court,\u00a0<strong>Luciana Sangiovanni<\/strong>, wrote: &#8220;The detentions were not validated in the application of the principles, binding for national judges and for the administration itself, put forth\u00a0by the recent ruling of the European Court of October 4, 2024, following the preliminary reference proposed by the judge of the Czech Republic.
