{"id":400229,"date":"2024-10-24T17:23:39","date_gmt":"2024-10-24T15:23:39","guid":{"rendered":"https:\/\/www.eunews.it\/2024\/10\/24\/ex-eurodeputato-restituire-250mila-euro\/"},"modified":"2024-10-29T17:11:13","modified_gmt":"2024-10-29T16:11:13","slug":"former-italian-mep-european-parliament","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2024\/10\/24\/former-italian-mep-european-parliament\/","title":{"rendered":"Former Italian MEP to return \u20ac250,000 to the European Parliament"},"content":{"rendered":"<p>Brussels &#8211; A <strong>former Italian MEP from the European People&#8217;s Party<\/strong> has been finally <strong>condemned<\/strong> by the Court of Justice of the EU to pay \u20ac250,000 for fraud against the European Parliament. At the centre of the <strong>audits <strong>by the Parliament&#8217;s anti-fraud office<\/strong> <\/strong>(<strong><a href=\"https:\/\/anti-fraud.ec.europa.eu\/index_en\" target=\"_blank\" rel=\"noopener\">OLAF<\/a><\/strong>) was the fictitious hiring of a parliamentary assistant and the payment of sums to a company, of which the assistant was the sole partner.<\/p>\n<p>OLAF opened the file against<strong> <strong>Crescenzio Rivellini <\/strong><\/strong>(FI\/EPP), who was present in Brussels from 2009 to 2014 in the Popular Party. The EU&#8217;s anti-fraud office investigated the<strong> <strong>hiring of his parliamentary assistant<\/strong><\/strong>, given the \u20ac25,000 claimed as reimbursement for expenses and the absence of documents proving her work, and the<strong>\u00a0<strong>over \u20ac220,000 claimed for the execution of so-called &#8220;controversial contracts&#8221;<\/strong><\/strong>.<\/p>\n<p>These contracts were allegedly <strong><strong>stipulated with a company that would provide services to Rivellini<\/strong> <\/strong>during his tenure. Too bad that the company had as its only partner<strong> <strong>his assistant<\/strong>, who<\/strong>, by the way,<strong>\u00a0<strong>was\u00a0<\/strong>also <strong>the MEP&#8217;s<\/strong> historical partner<\/strong>, as he\u00a0wrote in his<strong> <a href=\"http:\/\/www.enzorivellini.com\/wp-content\/uploads\/2015\/12\/Nomi_Cognomi_Rivellini.pdf\" target=\"_blank\" rel=\"noopener\">book<\/a> <\/strong>(&#8220;Bianca Maria D&#8217;Angelo was for ten years the partner of my life,&#8221; to quote an excerpt).<strong>\u00a0<\/strong><\/p>\n<p><strong>&#8220;<strong>European-style Bonnie and Clyde&#8221; <\/strong><\/strong>were discovered by OLAF<strong> and the <strong>former MEP was condemned by the EU Court of Justice<\/strong><\/strong>. Rivellini would have\u00a0never<strong> provided any evidence of D&#8217;Angelo&#8217;s actual employment<\/strong>, exploiting the alleged lack of clarity of a parliamentary assistant&#8217;s duties.<\/p>\n<p>The former EPP member sought to <strong>overstep the rules of the Statute for Members of the European Parliament<\/strong>, which stipulates the need also to justify expenses for staff employed by MEPs. The Luxembourg judges clarified that &#8220;<strong>the Member must in particular produce supporting documents relating to the activities of the Parliamentary Assistant and, therefore, retain them<\/strong>, and this even in the absence of an explicit obligation.&#8221;<\/p>\n<p>Rivellini <strong>attempted to prove that D&#8217;Angelo had a badge to enter. <\/strong>Still, again\u00a0the Court <strong>disallowed his argument<\/strong>, ruling that &#8220;the mere physical presence of the parliamentary assistant on the premises of the Parliament [&#8230;] cannot be sufficient to prove the actual performance of duties.&#8221; In addition, D&#8217;Angelo did not even reside in Brussels when she theoretically would have engaged in daily work in Parliament.<\/p>\n<p>Regarding companies, the <strong>Statute of MEPs specifies that there should be no conflict of interest<\/strong>. Rivellini attempted to <strong>contest the relationship between him and D&#8217;Angelo<\/strong>, despite the book that said otherwise and that the CJEU could use as evidence. Quite an own goal\u00a0for the former MEP, who wrote in black and white his self-disclosure and the presence of an obvious conflict of interest.<\/p>\n<p>In addition, <strong>the validity of the payments made was never proven by the Parliament<\/strong>, lacking &#8220;notifications (from Parliament) certifying the regularity of the payments made under the &#8216;disputed contracts'&#8221; and evidence that the payments were related to the contracts signed.\u00a0As a result, the \u20ac220,000 was not entitled to any<br \/>\nreimbursement from Parliament.<\/p>\n<p><span style=\"margin: 0px; padding: 0px;\">Hence came the condemnation of Rivellini and the compensation claim.<\/span>\u00a0<span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">Ironically, during his European mandate,\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">Rivellini<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">\u00a0was part of the\u00a0<\/span><a style=\"text-align: inherit; font-family: var(--body-font-family);\" href=\"https:\/\/www.europarl.europa.eu\/committees\/en\/cont\/home\/highlights\" target=\"_blank\" rel=\"noopener\">Budgetary Control Committee<\/a><span style=\"text-align: inherit;
