The coordinated work of the European Commission and the\u00a0<a href=\"https:\/\/commission.europa.eu\/live-work-travel-eu\/consumer-rights-and-complaints\/enforcement-consumer-protection\/consumer-protection-cooperation-network_en?prefLang=it&amp;etrans=it\" target=\"_blank\" rel=\"noopener\">Consumer Protection Cooperation Network<\/a> has uncovered the <strong>presence of practices that are likely to be contrary to EU rules<\/strong>, for which Temu will have to answer.<\/p>\n<p>The CPC Network has identified a number of\u00a0<strong><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_24_5707\" target=\"_blank\" rel=\"noopener\">elements<\/a> <\/strong>that <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A02017R2394-20220101\" target=\"_blank\" rel=\"noopener\">openly contrast with the reference European legislation<\/a>,\u00a0<strong>EU Regulation 2017\/2394<\/strong>. It certainly does not protect consumers the <strong>presence of untrue discounts<\/strong> or &#8220;<strong>pressure selling<\/strong>,&#8221; with false claims about limited supplies or false purchase deadlines inviting them to finalise the purchase quickly. Even less regular is the <strong>so-called forced &#8220;gamification&#8221;<\/strong>, that is, forcing consumers using the Temu site to participate in fake &#8220;wheels of fortune&#8221; to enter the site and win promotions and discounts.<\/p>\n<p>Moreover, <strong>the consumer&#8217;s <strong>right to return and receive refunds<\/strong>\u00a0<\/strong>is reportedly not be respected, with little information available (often misleading, by the way), and it appears to be impossible to <strong>interact directly with the company<\/strong>, as contacts are hard to find. The\u00a0<strong>presence of reviews<\/strong> that the national CPC authorities part of the investigation suspect to be <strong>false<\/strong>\u2014 whereby the qualities of products are bragged about misleading consumers\u2014is serious.<\/p>\n<p>In addition, the Chinese online retail giant has been asked to <strong>comply with other parts of the EU Regulations<\/strong> as well, such as ensuring that all\u00a0<strong>environmental claims are accurate and substantiated<\/strong>.<\/p>\n<p><strong>Temu has one month to defend itself against the allegations of the CPC Network<\/strong> and come up with a strategy on how to protect consumers while complying with the rules of EU law. It is not a given that it\u00a0will be able to convince the EU executive and the &#8220;watchdogs&#8221; of consumer protection. There are two possibilities: if Temu proposes a convincing solution for the CPC Network, a mediation dialogue will be opened with the company. <strong>If European demands are not considered, national authorities can take measures<\/strong> to ensure compliance, such as fines on the company&#8217;s annual turnover.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Investigations by the EU executive and the Consumer Protection Network have uncovered elements contrary to EU rules.
