Backtrack for seven more migrants, Rome judges call in EU court"},"content":{"rendered":"<p>Brussels &#8211; <strong>The Albania experiment of the Meloni government continues to fail<\/strong>. The <strong>Court\u00a0of Rome<\/strong> has announced that the <strong>transfer proceedings of seven more migrants\u00a0<\/strong><span style=\"margin: 0px; padding: 0px;\"><strong>have been suspended,<\/strong>\u00a0and the ball has been passed\u00a0<\/span>to the Court of Justice of the EU (CJEU).<\/p>\n<p><strong><a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/18\/engines-in-full-reverse-migrants-brought-from-italy-to-albania-must-return-to-bari\/\" target=\"_blank\" rel=\"noopener\">Not even a month ago<\/a>, the Meloni government\u00a0<\/strong><span style=\"margin: 0px; padding: 0px;\"><strong>received the first stop<\/strong>\u00a0from the Court of Rome, with the suspension of the transfer of twelve migrants to Albania<\/span>.\u00a0<span style=\"margin: 0px; padding: 0px;\"><strong>Today<\/strong>\u00a0(Nov. 11), the court&#8217;s decision was the same<span style=\"margin: 0px; padding: 0px;\">.\u00a0<strong>There<\/strong><\/span><strong>\u00a0is no validation of the detentions within the 48 hours required by law,<\/strong>\u00a0and since they cannot remain in the repatriation centre in Gjader,\u00a0<strong>the migrants will be returned to Italy<\/strong>\u00a0in the coming hours.<\/span><\/p>\n<p>The seven shipwrecked people had been transported on the ship Libra to Albania. There were originally eight, one of whom was sent back to Italy because of his\u00a0&#8220;vulnerable&#8221; conditions. The other seven, however, were forced to endure a one-way trip followed by an express\u00a0return, given the (alleged) <strong>incompatibility of the Italian law decree with EU regulations<\/strong>.<\/p>\n<p>The note of <strong>President<\/strong>\u00a0<strong>of the Chamber Luciana Sangiovanni<\/strong> states, &#8220;<strong>The preliminary referral was chosen as the most appropriate tool<\/strong> to clarify various profiles of doubtful compatibility with the supranational discipline. In fact, it allows the EU Court of Justice to be asked to resolve the issue by giving its own interpretation. And the CJEU&#8217;s position leaves no escape, as national courts must comply.<\/p>\n<p>The crucial point is the\u00a0<strong>definition of &#8220;safe country,&#8221;<\/strong> on which Roman jurisprudence has asked the EU for clarification. The European legal reference is a CGUE ruling of Oct. 4, 2024, which speaks of &#8220;safe countries&#8221; as those states that are so <em>in toto<\/em> and for each of their persons and, consequently, are adequate to receive repatriations.<\/p>\n<p>Sangiovanni points out the <strong>divergence of interpretation of EU law between the Meloni government&#8217;s decree law and Italian jurisprudence<\/strong>. EU law prevailing, Sangiovanni says, &#8220;The judge has the duty to always and concretely verify (its, ed.) correct application.&#8221;\u00a0<span style=\"margin: 0px; padding: 0px;\"><strong>In other words, if the decree is contrary to EU rules, it is not applicable,<\/strong>\u00a0and therefore, once again, Italy finds itself having to ask the EU for confirmation on what to do.<\/span><\/p>\n<p>The fact is that <strong>the<\/strong> <strong>European Commission likes &#8220;the Albania model&#8221;<\/strong> very much. Creating &#8220;<strong><a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/10\/on-returns-of-irregular-migrants-the-27-member-states-postpone-the-decision-but-political-consensus-grows-on-external-hotspots-along-the-albanian-model\/\" target=\"_blank\" rel=\"noopener\">external hotspots<\/a>&#8221; as alternative methods<\/strong> to counter illegal migration is no longer an idea of a few but has become established in European political discourse. <strong>Even von der Leyen <a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/15\/external-hotspots-for-migrants-ursula-von-der-leyen-speaks-out-lets-learn-from-the-italy-albania-protocol\/\" target=\"_blank\" rel=\"noopener\">declared<\/a> with great openness<\/strong>: &#8220;As the operations of the Italy-Albania protocol begin, we will also\u00a0<strong>be able to learn from this practical experience<\/strong>.&#8221;<\/p>\n<p><strong>The problem is that the practical experience does not work<\/strong> and clearly clashes with EU law regarding return security. <strong>In the <a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/17\/immigration-eu-embraces-the-meloni-line-consider-alternative-ways-to-counter-irregular-migration\/\" target=\"_blank\" rel=\"noopener\">conclusions of the October European Council,<\/a> EU leaders had taken advantage<\/strong> with the\u00a0<strong>recognition to national governments of the ability to act autonomously<\/strong>, ostensibly to support the Union in handling the claims of asylum seekers who do not qualify. This certainly brought a smile to the face of Meloni&#8217;s executive, who had secured more room for manoeuvre.<\/p>\n<p><strong>Even in the EU Parliament, the waters are rough<\/strong>. The far-right opening of the European People&#8217;s Party (EPP) should not be underestimated. During the <a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/23\/epp-sends-von-der-leyen-majority-adrift-on-budget-votes-united-with-extreme-right-but-loses\/\" target=\"_blank\" rel=\"noopener\">2025\u00a0budget votes<\/a>, the <strong>EPP<\/strong> had shaken hands with the motions of far-right parties regarding countering illegal migration. As chance would have it, the EPP was so fond of one of the proposals regarding the development of\u00a0<strong>repatriation hubs outside the Union<\/strong>, at the proposal of the far-right group Patriots for Europe.<\/p>\n<p>If even the largest group in the EU Parliament is winking at proposals that appear to be borderline legal, it is clear that European politics is veering increasingly to the right, and, again, this can only strengthen the Italian government.<\/p>\n<p><strong>Italian Vice-Premier Matteo Salvini, as usual, slams the ruling<\/strong> <a href=\"https:\/\/x.com\/matteosalvinimi\/status\/1856022920490840106\">writing on\u00a0X<\/a>:<\/p>\n<blockquote data-o-mail-quote-node=\"1\" data-o-mail-quote=\"1\"><p>Another political ruling not against the government, but against Italians and their security.<\/p>\n<p>Government and Parliament have the right to react to protect citizens, and they will. That is, if some other magistrate, in the meantime, does not sentence me to six years in jail for defending the borders&#8230;.<\/p>\n<p>@#<a href=\"https:\/\/x.com\/matteosalvinimi\"><span class=\"css-1jxf684 r-bcqeeo r-1ttztb7 r-qvutc0 r-poiln3\">matteosalvinimi<\/span><\/a> &#8211; 6:15 PM &#8211; 11 Nov 2024<\/p><\/blockquote>\n<p style=\"margin-bottom: 0px;\">But the Court&#8217;s ruling, <strong>rather than political, seems prudent<\/strong>.
