After Poland&#8217;s president had asked his government not to <strong>arrest the leader of the Jewish state<\/strong> if he visited Auschwitz to <strong>commemorate the victims of the Holocaust<\/strong>, it was the turn of the <strong>Romanian prime minister<\/strong> over the weekend, who <strong>directly invited his Middle Eastern counterpart to Bucharest<\/strong>. Both EU states, however, would technically be <strong>obliged to arrest Netanyahu<\/strong> if he set foot on their territory.<\/p>\n<p class=\"p1\">Under the Romanian sky, a stir was caused by the invitation extended by the social-democratic Prime Minister <strong>Marcel Ciolacu<\/strong> to his Israeli counterpart, to whom he proposed <strong>visiting Bucharest to meet him personally<\/strong>.<\/p>\n<p class=\"p1\">The outgoing prime minister (who <a href=\"https:\/\/www.eunews.it\/en\/2024\/12\/23\/romania-president-instructs-outgoing-pm-ciolacu-to-form-new-government\/\" target=\"_blank\" rel=\"noopener\">is looking for the solution<\/a> to form a new government after last month&#8217;s elections) has been the <strong>first foreign leader to visit the Jewish state after\u00a0the October 7, 2023<\/strong> attacks, in response to which Tel Aviv launched a\u00a0<strong>violent military campaign in the Gaza Strip<\/strong> that has\u00a0<a href=\"https:\/\/www.eunews.it\/en\/2025\/01\/16\/eu-welcomes-gaza-ceasefire-but-israel-delays-green-light-for-agreement-and-continues-raids\/\" target=\"_blank\" rel=\"noopener\">just been stopped<\/a> by a <strong>ceasefire<\/strong>, about whose stability, however, doubts remain.<\/p>\n<blockquote class=\"twitter-tweet\" data-o-mail-quote-node=\"1\" data-o-mail-quote=\"1\">\n<p dir=\"ltr\" lang=\"en\">Romania and Israel share a relation of strategic importance and solidarity is part of our bonds. We will continue our joint efforts to promote peace and security and implement the different economic &amp; security projects I agreed with PM <a href=\"https:\/\/twitter.com\/netanyahu?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@netanyahu<\/a>. We will also work to prepare the\u2026<\/p>\n<p>&#8211; Marcel Ciolacu (@CiolacuMarcel) <a href=\"https:\/\/twitter.com\/CiolacuMarcel\/status\/1881011252752736591?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">January 19, 2025<\/a><\/p><\/blockquote>\n<p class=\"p1\">The controversy, which erupted yesterday (Jan. 19) but is not likely to die anytime soon, revolves around the <strong>arrest warrant for war crimes and crimes against humanity<\/strong>\u2014in connection precisely with Israeli operations in Gaza, which <a href=\"https:\/\/www.reuters.com\/world\/middle-east\/how-many-palestinians-has-israels-gaza-offensive-killed-2025-01-15\/\" target=\"_blank\" rel=\"noopener\">have claimed<\/a> <strong>over 46 thousand casualties, most of them civilians<\/strong> (and an estimated 18 thousand minors)\u2014<a href=\"https:\/\/www.eunews.it\/en\/2024\/11\/21\/the-hague-issued-arrest-warrant-for-netanyahu-and-gallant-charged-with-war-crimes-and-crimes-against-humanity\/\" target=\"_blank\" rel=\"noopener\">issued last November<\/a> against Netanyahu and his former Defense Minister <strong>Yoav Gallant<\/strong> by the <strong>International Criminal Court (ICC)<\/strong>, the Hague-based UN tribunal established by the 1998 Rome Statute and which, at least theoretically, is supposed to enforce international law.<\/p>\n<p class=\"p1\"><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">In reality, the enforcement of the Court&#8217;s rulings is in the hands\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">of the countries that recognize its authority<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">: among the 125 parties to the Statute are\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">all 27 members of the EU,<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">\u00a0but missing among others are the\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">United States<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">,\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">Russia<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">,\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">China<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">\u00a0and, indeed,\u00a0<\/span><strong style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family);\">Israel<\/strong><span style=\"text-align: inherit; color: var(--body-color); font-family: var(--body-font-family); font-weight: var(--body-font-weight);\">.<\/span>\u00a0By formally recognising the jurisdiction of the ICC, <strong>the Twenty-Seven technically incur an obligation to implement arrest warrants<\/strong> issued by it, such as those against Russian President <strong>Vladimir Putin<\/strong> or Netanyahu and Gallant. An obligation <a href=\"https:\/\/www.eunews.it\/en\/2024\/11\/26\/arrest-warrant-compliance-against-netanyahu-holds-the-stage-at-g7-foreign-affairs-borrell-it-is-not-a-choice-but-an-obligation\/\" target=\"_blank\" rel=\"noopener\">clearly recalled<\/a> to European chancelleries by the then High Representative for Foreign Policy, <strong>Josep Borrell<\/strong>, at the last ministerial meeting in Foreign Affairs format of the G7 under Italian chairmanship.<\/p>\n<p class=\"p1\">And yet, as the Romanian case shows, <strong>politics once again prevails over law<\/strong>. On the entry into force of the ceasefire, EU Parliament President <strong>Roberta Metsola<\/strong> hailed at the opening of the plenary session in Strasbourg &#8220;<strong>the progress we all hoped for and so many desperately needed<\/strong>,&#8221; hoping &#8220;that the work toward a better tomorrow will continue&#8221; and &#8220;become <strong>the springboard for lasting stability<\/strong>, reconstruction, and increased aid that offers <strong>a real prospect for peace in the region<\/strong>.&#8221;<\/p>\n<p class=\"p1\">After all, the one in Bucharest is not a bolt from the blue. Only <a href=\"https:\/\/notesfrompoland.com\/2025\/01\/09\/polish-president-asks-government-to-guarantee-netanyahu-wont-be-arrested-on-auschwitz-visit\/\" target=\"_blank\" rel=\"noopener\">a few weeks ago<\/a>, Polish President <strong>Andrzej Duda<\/strong> asked the government led by political rival <strong>Donald Tusk<\/strong> (the latter <strong>a prominent member of the centre-right European People&#8217;s Party<\/strong>, while the former is <strong>close to the ultranationalist right-wing PiS<\/strong>) to <strong>guarantee that the Israeli leader would not be arrested<\/strong> if he decided to travel to the country for the <strong>80th anniversary celebration of the liberation of the Auschwitz concentration camp<\/strong>, scheduled for Jan. 27.<\/p>\n<p class=\"p1\">At the moment, however, it appears that <strong>Netanyahu does not intend to attend the ceremony<\/strong> precisely for fear that <strong>Polish authorities may take him into custody<\/strong> in compliance with the ICC warrant.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>First Poland, then Romania.
