Brussels – Stop discrimination against fixed-term teachers\u00a0is the call from<\/strong>\u00a0the European Commission to Italy, which has not aligned its national legislation to the EU directive<\/strong> on the subject dating back to 1997. The key issue is\u00a0the gradual salary progression<\/strong> based on seniority, which teachers with\u00a0fixed-term contracts<\/strong>\u00a0are not entitled to,\u00a0contrary to permanent ones.<\/p>\n

In a communication dated Feb. 12, the EU executive said<\/a>\u00a0(in decision No. 8) it has\u00a0initiated infringement proceedings against Rome<\/strong> because, under Italian law, “fixed-term teachers are not entitled to a\u00a0gradual salary progression\u00a0<\/strong>based on\u00a0previous periods of service<\/strong>, contrary to\u00a0permanent teachers<\/strong>.” According to Brussels, this disparity of treatment\u00a0represents<\/strong>\u00a0“discriminatory working conditions<\/strong>” that violate EU law, which enshrines the principle of non-discrimination<\/strong>.<\/p>\n

Therefore, the Commission has sent a letter of formal notice<\/strong> to Italy, which now has two months<\/strong> to explain how it intends to remedy<\/strong> the highlighted shortcomings<\/strong>. Otherwise, the Berlaymont can issue a reasoned opinion<\/strong>, which is the second step in the infringement procedure. In the face of any further non-compliance by the Italian government, the matter could end up before the\u00a0EU Court of Justice<\/strong>, which could impose\u00a0fines<\/strong>.<\/p>\n

But how large\u00a0is the affected group? Out of 943,681 teachers<\/strong> active nationwide in the 2022\/2023 school year,<\/strong> just under a quarter (234,576) had fixed-term contracts <\/strong>(data from the Ministry of Education and Merit<\/a>).
