In this matter, the <strong>Court of Justice of the European Union<\/strong> (CJEU) ruled that EU law is not opposed to imposing\u00a0a <strong>ceiling<\/strong> on the percentage of the rental or sales price that real estate agents can collect for their brokerage service, specifically a cap of <strong>4 percent<\/strong>.<\/p>\n<p>Referring the case\u00a0to the Luxembourg court was the Constitutional Court of <strong>Slovenia<\/strong>, which had doubts about the legality and conformity with EU law of a national law imposing this limit on agencies for single-family residential buildings or apartments purchased or rented by individuals.<\/p>\n<p>In its <a href=\"https:\/\/curia.europa.eu\/juris\/fiche.jsf?id=C%3B674%3B23%3BRP%3B1%3BP%3B1%3BC2023%2F0674%2FP&amp;nat=or&amp;mat=or&amp;pcs=Oor&amp;jur=C%2CT%2CF&amp;num=C-674%252F23&amp;for=&amp;jge=&amp;dates=&amp;language=it&amp;pro=&amp;cit=none%252CC%252CCJ%252CR%252C2008E%252C%252C%252C%252C%252C%252C%252C%252C%252C%252Ctrue%252Cfalse%252Cfalse&amp;oqp=&amp;td=%3BALL&amp;avg=&amp;lgrec=it&amp;lg=&amp;cid=15460031\" target=\"_blank\" rel=\"noopener\">judgment<\/a>, the CJEU\u00a0excluded the discriminatory nature of the measure and added that setting a cap on commissions appears &#8220;to be such as to promote the <strong>accessibility<\/strong> of adequate housing at affordable prices, given that the commission amount is likely reflected in the sale price or rent amount.&#8221;\u00a0The Court\u00a0also pointed out that this is particularly relevant for vulnerable people, namely students, young people, and older people, who are more sensitive to rising property prices. It can contribute to<strong> consumer protection<\/strong> transparency and prevent excessive fees.<\/p>\n<p>Since it\u00a0is a <strong>judgment<\/strong>, the EU Court of Justice\u00a0provision affects Slovenia and\u00a0our real estate market: it is <a href=\"https:\/\/www.europarl.europa.eu\/factsheets\/it\/sheet\/12\/le-competenze-della-corte-di-giustizia-dell-unione-europea\" target=\"_blank\" rel=\"noopener\">binding<\/a> for all national judges presented with\u00a0an identical case.\u00a0Although the price of houses in<strong> Italy<\/strong> is decreasing, rental costs, in line with the rest of European countries, are increasing.
