This market growth, however, does not seem to be accompanied by an increase in <strong>transparency<\/strong> on the part of retailers, at least as far as the old continent is concerned.<\/p>\n<p>An\u00a0<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_25_706\" target=\"_blank\" rel=\"noopener\">investigation<\/a>\u00a0by the <strong>EU Commission,<\/strong> with the participation of a <a href=\"https:\/\/commission.europa.eu\/live-work-travel-eu\/consumer-rights-and-complaints\/enforcement-consumer-protection\/consumer-protection-cooperation-network_en\" target=\"_blank\" rel=\"noopener\">network\u00a0<\/a>of\u00a0<strong>national consumer protection authorities<\/strong> of 25 member states (including Italy), Norway, and Iceland, released the results of its online monitoring operation on\u00a0second-hand sellers. It concluded that out of 365 retailers surveyed, 185 (<strong>52 percent<\/strong>) were potentially <strong>in breach\u00a0of EU<\/strong> consumer protection law. In addition to national laws, five European directives regulate the sale of online and offline products, including <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32011L0083\" target=\"_blank\" rel=\"noopener\">consumer<\/a> rights\u00a0and\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32000L0031\" target=\"_blank\" rel=\"noopener\">e-commerce<\/a> directives.<\/p>\n<p>In particular, 40 percent of observed retailers did not\u00a0inform consumers of their <strong>rights of withdrawal<\/strong> (such as the right to return the product within 14 days without justification or cost), while 45 percent did not correctly inform consumers of their right to return faulty goods or goods that do not look or work as advertised; 57% did not respect the minimum period of one-year legal <strong>guarantee <\/strong>for second-hand goods, while <strong>among those who make environmental claims on their site, 20 percent were not\u00a0sufficiently substantiated, while 28 percent were manifestly false<\/strong> or likely to qualify as <strong>unfair commercial practices<\/strong>.<\/p>\n<p>The investigation also stressed the importance of verifying that sellers properly attest to their <strong>identity<\/strong> (this is not the case for 5 percent of cases) and that the product&#8217;s\u00a0<strong>total price<\/strong>, including taxes, is provided (not provided in 8 percent of cases).
