The Parliament in Budapest has approved a controversial\u00a0<strong>amendment to the Constitution<\/strong> that, in effect, puts <strong>a tombstone on<\/strong> <strong>freedom of association<\/strong> for members of the LGBTQ+ community (and those who demonstrate in their favour). The Magyar premier&#8217;s <strong>illiberal repression<\/strong> will now also be able to use facial recognition technologies, which critics challenge as a <strong>worrying authoritarian twist<\/strong>.<\/p>\n<p class=\"p1\">In yet another black day for Hungarian democracy, the <strong>National Assembly<\/strong> (the central European country&#8217;s single-chamber legislature) adopted this afternoon (April 14) by 140 votes to 21 a <strong>controversial amendment to the Basic Charter<\/strong> that severely restricts <strong>the rights and civil liberties of Magyar citizens<\/strong> who are part of the <strong>LGBTQ+<\/strong> community.<\/p>\n<p class=\"p1\">The motion, strongly sought by <strong>Fidesz<\/strong> (the national-populist party of <strong>Viktor Orb\u00e1n<\/strong>, an ally of <strong>Matteo Salvini<\/strong> and <strong>Marine Le Pen<\/strong> in Strasbourg and which holds the <strong>two-thirds majority<\/strong> in the House needed to reform the Constitution), amends the <strong>Assembly Legislation<\/strong> and formally codifies as a crime <strong>organising or participating in events<\/strong> that violate the highly contested <strong>Child Protection Law<\/strong>, starting with the <strong>Budapest Pride<\/strong> that <a href=\"https:\/\/www.eunews.it\/en\/2025\/03\/17\/hungary-government-introduces-bill-to-ban-pride-in-budapest\/\" target=\"_blank\" rel=\"noopener\">had already been banned<\/a> with an <i>ad hoc<\/i> measure not even a month ago.<\/p>\n<p class=\"p1\">The <strong>Child Protection Law<\/strong>, dating back to 2021, bans &#8220;<strong>the depiction and promotion<\/strong>&#8221; to <strong>minors under 18<\/strong> of content branded by the ultraconservative executive as &#8220;<strong>homosexual propaganda<\/strong>.&#8221; The goal would be to <strong>safeguard the physical, mental, and moral development of minors<\/strong>, which thus gains precedence over other fundamental rights such as those <strong>of assembly, demonstration, and free expression<\/strong>. The amendment voted today allows\u00a0<span style=\"margin: 0px; padding: 0px;\">law enforcement agencies to use\u00a0<strong>mass social surveillance technologies<\/strong>\u2014especially those for\u00a0<strong>facial recognition<\/strong><\/span>. Participants in banned rallies might thus\u00a0be <strong>identified and fined<\/strong> up to 200,000 forints (about \u20ac487), as in the People&#8217;s Republic of China and Georgia, two countries whose governments do not shine in their commitment to protecting democracy.<\/p>\n<p class=\"p1\">In addition, MPs approved a crackdown on <strong>double nationality holders<\/strong>, granting the government the power to temporarily suspend Hungarian citizenship to anyone judged to be a <strong>&#8220;threat&#8221; to security<\/strong> (but only in cases where the second passport is from a state outside the European Economic Area). This is, again, an\u00a0<i>addendum<\/i> to the <strong>controversial Foreign Agents Law<\/strong>, adopted to <strong>protect the country&#8217;s sovereignty from outside interference<\/strong>.<\/p>\n<p class=\"p1\">With that measure, which closely traces a similar law that has been in effect for more than a decade in <strong>Vladimir Putin<\/strong> Russia, Orb\u00e1n <a href=\"https:\/\/www.eunews.it\/en\/2025\/03\/17\/the-two-demonstrations-in-budapest-orban-vs-magyar-the-opposition-leader\/\" target=\"_blank\" rel=\"noopener\">is trying to knock out<\/a> all <strong>entities that receive funding from third countries<\/strong>, in an attempt to <strong>further silence critical voices<\/strong> that still try to oppose his capture of the Magyar state. Today&#8217;s is the <strong>15th amendment to the Constitution<\/strong> since the premier returned to power in 2010.<\/p>\n<p class=\"p1\">The reactions of the <strong>opposition parties<\/strong> and <strong>civil society associations<\/strong> underscore the risks associated with the <strong>authoritarian inroads of the &#8220;illiberal&#8221; Orban &#8220;state&#8221;<\/strong>. Together with <strong><i>Amnesty international<\/i><\/strong> and other organizations, it called on the European Commission to initiate a new <strong>infringement procedure against the country for violation of EU law<\/strong>.<\/p>\n<p class=\"p1\">Indeed, today, a delegation from the\u00a0<strong>European Parliament&#8217;s Committee on Civil Liberties and Rights (LIBE)<\/strong> arrived in Budapest and will stay until Wednesday to monitor developments on the ground. The Strasbourg Chamber <a href=\"https:\/\/www.eunews.it\/en\/2025\/04\/02\/europe-is-getting-fed-up-with-viktor-orban\/\" target=\"_blank\" rel=\"noopener\">has long criticised<\/a> the deterioration of democracy in the country, including the <strong>dismantling of the rule of law<\/strong> and the continued violation of fundamental freedoms and human rights.
