With the latest blows dealt\u00a0to the rule of law in Hungary &#8211; the crackdown on the LGBT+ community and the <a href=\"https:\/\/www.eunews.it\/en\/2025\/03\/17\/hungary-government-introduces-bill-to-ban-pride-in-budapest\/\" target=\"_blank\" rel=\"noopener\">ban<\/a> on Budapest Pride &#8211; and those to come &#8211; the probable adoption of the law on the &#8220;transparency of public life&#8221; &#8211; <strong>Viktor Orb\u00e1n<\/strong> risks having crossed the line. After the condemnation by\u00a020 member states for the ongoing democratic regression and the warnings of the European Commission, the EU Agency for Fundamental Rights (FRA) is also sounding the alarm: the latest developments &#8220;could <strong>violate the Charter of Fundamental Rights of the European Union&#8221;<\/strong> and &#8220;the values enshrined in the treaties.&#8221;<\/p>\n<p>In a<a href=\"https:\/\/fra.europa.eu\/it\/news\/2025\/fra-statement-recent-developments-affecting-civil-society-and-fundamental-rights\" target=\"_blank\" rel=\"noopener\">\u00a0statement<\/a> released last night (May 29), the Vienna-based agency expressed &#8220;deep concern&#8221; over moves by Orb\u00e1n&#8217;s ultra-conservative government. In addition, they c<strong>ompromise the broader commitment to the EU values<\/strong> enshrined in the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/treaty\/teu_2012\/art_2\/oj?locale=it\" target=\"_blank\" rel=\"noopener\">Article 2 of the Treaty on the European Union<\/a>. These include &#8220;respect for human dignity, human rights, minority rights, pluralism, non-discrimination, tolerance, justice, solidarity and equality.&#8221;<\/p>\n<p style=\"margin-bottom: 0px;\">The agency, headed by Irishman <strong>Michael O&#8217;Flaherty<\/strong>, insists: &#8220;Exceptional situation like the one developing in Hungary \u2013 such as legislating to enable a ban on the Budapest Pride \u2013<strong> can and should be prevented across the EU.<\/strong>&#8221; The appeal is directed to the European Commission, which is obliged to &#8220;assess the specifics of legislation&#8221; but must intervene by its role as guardian of the treaties.<\/p>\n<p style=\"margin-bottom: 0px;\">FRA highlights a\u00a0second serious: Orb\u00e1n&#8217;s moves\u00a0(or more appropriately step backwards)\u00a0&#8220;reflect <strong>broader trends of democratic backsliding, shrinking civic space and challenges to fundamental rights across the EU<\/strong>.&#8221; A subtle process\u00a0that &#8220;rarely occurs through sudden ruptures&#8221;.\u00a0The EU Agency for Fundamental Rights has picked up on this and already written it in its annual reports for 2023 and 2024, which indicate &#8220;a marked deterioration of civic space in recent years in several EU Member States.&#8221; Through the adoption of laws restricting the right to peaceful assembly and the use of surveillance technologies, &#8220;a growing body of legal, administrative, and financial measures&#8221; targeting civil society organizations, journalists, and activists. In\u00a02018, the European Parliament initiated the\u00a0<strong>Article 7 procedure\u00a0of the Treaty<\/strong>: long stalled at the table of national governments, it could &#8211; in light of the 20 member states cornering Orb\u00e1n &#8211; reach the four-fifths consensus (22 out of 27) needed to proceed with the <strong>certification of &#8220;systematic and persistent violations&#8221; of the rule of law<\/strong>.
