Alongside the <strong>improvements recorded in several Member States<\/strong>, there are also <strong>different delays and, in some cases, setbacks<\/strong>. <strong>Hungary remains the black sheep<\/strong> of the twelve-star club, while <strong>Italy has little in the way of&nbsp;particularly commendable progress to show.<\/strong><\/p>\n<p class=\"p1\">The Commission published its<strong> sixth report on the health of the rule of law in the Union <\/strong>today (8 July), which was presented to journalists by Executive Vice-President in charge of Democracy <strong>Henna Virkkunen<\/strong>, and Justice Commissioner&nbsp;<strong>Michael McGrath<\/strong>.&nbsp;From Strasbourg, where the College was meeting in conjunction with the plenary session of the European Parliament, the two members of the second von der Leyen Commission&nbsp;presented the main results of the study, which <a href=\"https:\/\/www.eunews.it\/en\/2024\/07\/24\/rule-of-law-report-eu-enlargement\/\" target=\"_blank\" rel=\"noopener\">for the second year in a row<\/a> also includes some candidate countries: <strong>Albania<\/strong>, <strong>Northern Macedonia<\/strong>, <strong>Montenegro,<\/strong> and <strong>Serbia<\/strong>.&nbsp;<\/p>\n<p class=\"p1\">The annual report is the cornerstone of the so-called <strong>Rule of Law Cycle<\/strong>, a dialogue the Commission holds with chancelleries to <strong>monitor and encourage&nbsp;respect<\/strong> for <strong>democratic safeguards<\/strong>, <strong>civil liberties,<\/strong> and <strong>fundamental rights<\/strong> within the Union,&nbsp;aiming to prevent problems from arising or worsening.<\/p>\n<figure id=\"attachment_432007\" style=\"width: 1024px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-scaled.jpg\"><img decoding=\"async\" class=\"wp-image-432007 size-large\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-1024x683.jpg\" alt=\"Michael McGrath\" width=\"1024\" height=\"683\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-1024x683.jpg 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-300x200.jpg 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-768x512.jpg 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-1536x1024.jpg 1536w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-2048x1365.jpg 2048w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-750x500.jpg 750w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-774619-1140x760.jpg 1140w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption id=\"caption-attachment-432007\" class=\"wp-caption-text\">EU Justice Commissioner Michael McGrath (photo: Valentine Zeler\/Commissione europea)<\/figcaption><\/figure>\n<p class=\"p1\">McGrath emphasized that this was &#8220;a <strong>preventive tool<\/strong>&#8221;&nbsp;to prevent the activation of other, harsher methods such as <strong>Article 7 sanctions <\/strong>(which can lead to the suspension of a member state&#8217;s voting rights in the Council) or the <strong>freezing of European funds<\/strong> under the conditionality mechanism. Both instruments are <a href=\"https:\/\/www.eunews.it\/en\/2025\/04\/02\/europe-is-getting-fed-up-with-viktor-orban\/\" target=\"_blank\" rel=\"noopener\">currently in use<\/a> against <strong>Hungary, <\/strong>led by&nbsp;<strong>Viktor Orb\u00e1n<\/strong>, with <strong>over EUR 18 billion<\/strong> allocated to Budapest <a href=\"https:\/\/www.eunews.it\/en\/2024\/12\/16\/hungary-will-not-get-back-european-funds-frozen-for-rule-of-law-violations\/\" target=\"_blank\" rel=\"noopener\">blocked by the Berlaymont<\/a> for <strong>violating&nbsp;a long series of EU rules<\/strong>.<\/p>\n<p class=\"p1\">&#8220;The promotion and protection of the rule of law is a top priority,&#8221; said Virkkunen, noting that &#8220;<strong>our democracies are under attack<\/strong>&#8221; and cautioning that &#8220;<strong>we cannot take it for granted that the rule of law is in good health<\/strong>&#8221; across the Twenty-Seven. Despite positive trends in many member states, the Vice-President warned, there is &#8220;strong polarization and <strong>pressure on democratic institutions&#8221;<\/strong> throughout the Union.<\/p>\n<p class=\"p1\">The EU executive analyzed four key areas: the <strong>judicial system<\/strong>, <strong>anti-corruption regulations<\/strong>, <strong>media freedom,<\/strong> and <strong>democratic checks and balances<\/strong>. In addition, in the 2025 edition, Brussels&nbsp;adopted a <strong>specific focus on the single market<\/strong> because, McGrath explains, &#8220;the EU stands for legal certainty, which brings with it economic stability and prosperity,&#8221; going so far as to define the rule of law as the Old Continent&#8217;s &#8220;<strong>competitive advantage.&#8221;<\/strong><\/p>\n<p class=\"p1\">The Commission nevertheless tries to <strong>see the glass half full<\/strong>. &#8220;<strong>We see steady progress<\/strong>,&#8221; Virkkunen notes, pointing out that &#8220;more than half of the recommendations in the 2024 report have been fully or partially implemented&#8221;.&nbsp;However,&nbsp;<strong>problems remain<\/strong>, she admits, especially regarding <strong>the intrusion of political power into the justice sector,<\/strong> insufficient<strong> efforts to combat corruption<\/strong>, shortcomings in the <strong>protection of journalists<\/strong>, and <strong>pressures on civil society.<\/strong><\/p>\n<figure id=\"attachment_432009\" style=\"width: 1024px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-scaled.jpg\"><img decoding=\"async\" class=\"wp-image-432009 size-large\" src=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-1024x683.jpg\" alt=\"Henna Virkkunen\" width=\"1024\" height=\"683\" srcset=\"https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-1024x683.jpg 1024w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-300x200.jpg 300w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-768x512.jpg 768w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-1536x1024.jpg 1536w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-2048x1365.jpg 2048w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-750x500.jpg 750w, https:\/\/www.eunews.it\/wp-content\/uploads\/2025\/07\/P067486-860944-1140x760.jpg 1140w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption id=\"caption-attachment-432009\" class=\"wp-caption-text\">Commission Vice-President for Democracy and Technological Sovereignty, Henna Virkkunen (photo: Valentine Zeler\/European Commission)<\/figcaption><\/figure>\n<p>Particularly in some Member States, <strong>reforms are proceeding at too slow a pace<\/strong>, while in others, there <strong>has even been backtracking<\/strong>. The resources allocated to judicial systems are often undersized, with obvious repercussions on the <strong>quality and efficiency of proceedings<\/strong>. The i<strong>ndependence of judges<\/strong> and undue influence from the political world, on the other hand, are problems, especially in the <strong>enlargement countries.<\/strong><\/p>\n<p class=\"p1\">Regarding<strong> anti-corruption regulatory frameworks,<\/strong> seven Member States have implemented new strategies based on the findings of the 2024 report. However, Berlaymont sources said further action is still needed in <strong>various areas, including lobbying<\/strong> and the <strong>conflict of interest<\/strong> regulation.<\/p>\n<p class=\"p1\">The EU executive also wants to see progress, both in the Member States and in the candidate countries, in the area of <strong>media freedom and pluralism<\/strong>.&nbsp; Above all, the Commission officials note, for the <strong>protection of reporters<\/strong> and <strong>transparency in public financing<\/strong>, as well as the <strong>independence of the public service<\/strong> and certain r<strong>egulatory authorities<\/strong> in the sector.<\/p>\n<p class=\"p1\">Different chancelleries among the 27 member states are aligning their legislation with the European standards outlined in the <strong><i>Media Freedom Act;<\/i><\/strong> however, this is not always enough. Budapest has <strong>several cases before the EU Court of Justice<\/strong>, the vice-president recalled (<a href=\"https:\/\/www.eunews.it\/en\/2025\/06\/05\/eu-advocate-general-hungarys-clampdown-on-lgbt-rights-violates-eu-law\/\" target=\"_blank\" rel=\"noopener\">for example,<\/a>&nbsp;the controversial <strong>law on the protection of minors<\/strong>). Meanwhile, McGrath, who<br \/>\n<a href=\"https:\/\/www.eunews.it\/en\/2025\/06\/18\/eu-parliament-defends-budapest-pride-and-attacks-orban\/\" target=\"_blank\" rel=\"noopener\">has long had his eye on<\/a> the democratic backsliding taking place&nbsp;in the central European country, <a href=\"https:\/\/www.eunews.it\/en\/2024\/07\/24\/rule-of-law-eu-italy-slovakia-hungary\/\" target=\"_blank\" rel=\"noopener\">defined a year ago<\/a> by his predecessor <strong>Didier Reynders,<\/strong> &#8220;as a systemic problem&#8221; &#8211; reiterates&nbsp;how the EU <strong>executive is &#8220;ready to take further action&#8221;&nbsp;<\/strong>should the situation deteriorate further.<\/p>\n<p class=\"p1\">And what about&nbsp;<strong>Italy<\/strong>? The Commission report highlights <strong>some weak progress<\/strong>, for example, in public procurement, but on the road to reform, Rome seems to be lagging. A &#8220;<strong>serious problem&#8221;&nbsp;<\/strong>remains, among other things, in the <strong>duration of trials and the technological backwardness<\/strong> of the entire judicial system. At the same time, there have been no substantial steps forward regarding the <a href=\"https:\/\/www.eunews.it\/en\/2024\/07\/24\/non-independent-rai-unprotected-journalists-and-too-much-government-eu-warnings-on-the-rule-of-law-in-italy\/\">state broadcaster RAI<\/a>. Moreover, Ruotolo said, Italy &#8220;has dropped to <strong>49th place in press freedom<\/strong>, three places lower than last year, according to <i>Reporters sans fronti\u00e8res<\/i>.&#8221; Above all, he continues, &#8220;four Italian journalists <a href=\"https:\/\/www.eunews.it\/en\/2025\/02\/06\/paragon-spyware-case-breaks-out-in-italy-european-commission-unacceptable-if-proven\/\" target=\"_blank\" rel=\"noopener\">were illegally spied on<\/a>&#8221; through <strong>spyware from Paragon<\/strong>, the controversial Israeli company operating with US funds.<\/p>\n<p class=\"p1\">Overall, reforms are also progressing in the area of <strong>checks and balances, <\/strong>which are fundamental to the liberal-democratic constitutional framework, for example, through a <strong>greater openness of the legislative process<\/strong> to <strong>civil society stakeholders<\/strong>. However, there are still legal uncertainties due to, for instance, <strong>unstable regulatory frameworks<\/strong> as well as excessive restrictions (or inadequate protections) for civil society organizations.<\/p>\n<p class=\"p1\">Commission officials finally underline some developments concerning individual Member States. Although, for example,&nbsp; <strong>Slovakia still needs to make significant progress<\/strong>, the report assesses the dialogue with the authorities in Bratislava as &#8220;<strong>intense but positive.&#8221;<\/strong> In the case of <strong>Spain<\/strong>, the <strong>anti-corruption regime<\/strong> is central; however, an overall strategy is still lacking, and the revision of the legislative code is still ongoing. As for Warsaw, where the pro-European government of <strong>Donald Tusk<\/strong> has pledged to <strong>restore&nbsp;the rule of law&nbsp;<\/strong>after eight years of PiS&nbsp;eroding Polish democracy, the report notes positive efforts; however,&nbsp;in several cases, the <strong>measures implemented have not been sufficient<\/strong> or have not taken root.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Presented in Strasbourg, the 2025 Report examining the situation in the 27 member states and the four candidate countries, with a focus on the economic aspects of the issue.
