The government is allegedly carrying out a <strong>clampdown&nbsp;against the country&#8217;s main anti-corruption bodies<\/strong>, at least according to the complaints of oppositions, activists, and civil society. Officially, the motivation is that these institutions are the subject of an <strong>infiltration by a network of spies in the service of Russia<\/strong>.&nbsp;<span style=\"text-align: inherit\">But NGOs and the independent press denounce an&nbsp;<\/span><strong style=\"text-align: inherit\">authoritarian crackdown<\/strong><span style=\"text-align: inherit\">, which threatens to&nbsp;<\/span><strong style=\"text-align: inherit\">compromise <\/strong><a href=\"https:\/\/www.eunews.it\/en\/2024\/10\/30\/eu-enlargement-2-ukraines-dream-of-eu-accession-becomes-increasingly-concrete\/\" target=\"_blank\" style=\"text-align: inherit\"><strong>Kiev&#8217;s path to accession<\/strong><\/a>&nbsp;<strong style=\"text-align: inherit\">to the twelve-star club<\/strong><span style=\"text-align: inherit\">.<\/span><\/p>\n<p class=\"p1\">Governing a country at&nbsp;war is not easy, especially in a democracy. All the more so if it is historically plagued by <strong>chronic and documented corruption problems<\/strong>. One of the risks in these situations is that, while the army fights in the trenches and bombs rain down on civilians, the <strong>special powers granted by martial law<\/strong> are wielded by the political leadership to <strong>force or tamper with democratic infrastructure<\/strong>, masking these actions with the excuse of <strong>safeguarding national security<\/strong>.<\/p>\n<p class=\"p1\"><span style=\"margin: 0px;padding: 0px\">According to critics of&nbsp;<strong>Volodymyr Zelensky<\/strong>&#8216;s leadership, a good number of&nbsp;<strong>civil society organisations,<\/strong>&nbsp;as well as a part of the&nbsp;<strong>local independent press<\/strong>, believe that this is exactly what is happening in Ukraine right now.<\/span><\/p>\n<h3 id='the-amendments-to-the-penal-code'  id=\"boomdevs_1\">The amendments to the penal code<\/h3>\n<p class=\"p1\">The <strong>Verchovna Rada<\/strong>, the single-chamber parliament in Kyiv, today (22 July) approved by a large majority (263 votes in favour, 13 against, and 13 abstentions) a series of <strong>controversial amendments<\/strong> to the Criminal Code, with which, various observers denounce, the <strong>independence<\/strong> of the two main institutions for <strong>combating corruption<\/strong> is being <strong>shattered<\/strong>. The law is now <strong>under consideration<\/strong> by Zelensky, who can either enact it or veto it presidentially. Since last month, this role has been held by <strong>Ruslan Kravchenko<\/strong>, considered a loyal ally of Zelensky. If the law enters into force, Kravchenko will be able to <strong>intervene in NABU<\/strong> investigations, reassign them to other offices, and even close them directly. Similarly, he will be able to <strong>delegate the powers of the SAPO to other prosecutors<\/strong>.<\/p>\n<p class=\"p1\"><span style=\"text-align: inherit\">The leadership of both institutions in question has bitterly contested the law, arguing that it will&nbsp;<\/span><span style=\"margin: 0px;padding: 0px\"><span>ultimately destroy the country&#8217;s&nbsp;<\/span><strong>anti-corruption infrastructure<\/strong><span>&nbsp;painstakingly put in place over the&nbsp;<\/span><strong>decade following Euromaidan<\/strong><span>, and also jeopardise<\/span><\/span><span style=\"text-align: inherit\">&nbsp;Ukraine&#8217;s&nbsp;<\/span><strong style=\"text-align: inherit\">Euro-Atlantic integration<\/strong><span style=\"text-align: inherit\">.<\/span>&nbsp;MP <strong>Anastasiia Radina<\/strong>, head of the House committee in the SN quota, <a href=\"https:\/\/ti-ukraine.org\/en\/news\/statement-on-the-attempt-to-dismantle-ukraine-s-anti-corruption-system\/\" target=\"_blank\" rel=\"noopener\">said in no uncertain terms<\/a> that today&#8217;s vote amounts to the &#8220;<strong>dismantling of NABU and SAPO<\/strong>.&#8221;<\/p>\n<h3 id='ukrainian-service-searches'  id=\"boomdevs_2\">Ukrainian service searches&nbsp;<\/h3>\n<p class=\"p1\">Various monitoring bodies have raised the alarm about the potential for the government to&nbsp;<span style=\"margin: 0px;padding: 0px\">use these new provisions instrumentally to&nbsp;<strong>hinder ongoing investigations into entities, individuals,<\/strong><\/span><strong>&nbsp;or groups close to the president or the executive branch<\/strong> itself. Just today, NABU and SAPO accused a senior official of the <strong>Ukrainian Security Service (SBU)<\/strong> of extorting a <strong>$300,000 bribe<\/strong> together with two accomplices in exchange for facilitating the illegal expatriation&nbsp;of military-age men.<\/p>\n<p class=\"p1\">Yesterday alone (21 July), the SBU and the <strong>State Bureau of Investigation<\/strong> conducted <strong>over 70 searches on&nbsp;NABU and SAPO premises<\/strong>, <strong>arresting two employees<\/strong> of the former for allegedly spying for Russia and international drug trafficking, and <strong>investigating 15 others<\/strong> for violations ranging from traffic violations to high treason. However, the services returned the accusations to the sender, justifying the absence of warrants on the basis of <strong>national security protocols<\/strong>. The SBU&nbsp;<span style=\"margin: 0px;padding: 0px\">stated that it had gathered evidence of the&nbsp;<strong>transfer of confidential information to&nbsp;<\/strong><\/span><strong>Russian services (FSB)<\/strong>.<\/p>\n<h3 id='pressure-campaign'  id=\"boomdevs_3\">Pressure campaign?<\/h3>\n<p style=\"margin-bottom: 0px\">\nAccording to&nbsp;<span style=\"margin: 0px;padding: 0px\">opposition groups and civil society associations, the move is part of a&nbsp;<strong>wider pressure campaign<\/strong>&nbsp;targeting&nbsp;<strong>anti-corruption bodies, activists, NGOs,<\/strong><\/span>&nbsp;and, more generally, the country&#8217;s <strong>democratic structures<\/strong> themselves.\n<\/p>\n<p class=\"p1\">On 14 July, activist <strong>Vitaliy Shabunin<\/strong>, co-founder of the <strong>Anti-Corruption Action Centre (AntAC)<\/strong>, the country&#8217;s most prominent anti-corruption NGO, was <strong>arrested on charges of fraud and evading military service<\/strong>. Shabunin <a href=\"https:\/\/ti-ukraine.org\/en\/news\/stop-using-the-justice-system-for-political-persecution-civil-society-organizations-statement-on-the-case-of-vitaliy-shabunin\/\" target=\"_blank\" rel=\"noopener\">claims<\/a> that this is a <strong>politically motivated move<\/strong>, a position also defended by, among others, the NGO <strong>Transparency International<\/strong>.<\/p>\n<p class=\"p1\">The <strong><i>Kyiv Independent<\/i><\/strong>, one of the most internationally renowned independent Ukrainian media outlets, <a href=\"https:\/\/kyivindependent.com\/editorial-right-now-ukraines-democracy-risks-a-russian-style-backslide\/\" target=\"_blank\" rel=\"noopener\">writes<\/a>&nbsp;in no uncertain terms about the risk of a &#8220;<strong>Russian-style democratic regression&#8221;<\/strong> and the &#8220;<strong>sabotage of the rule of law&#8221;<\/strong> by the Ukrainian leadership, suggesting that the government wants to ensure a kind of &#8220;<strong>amnesty for corruption in the defence industry&#8221;<\/strong> at a critical moment in the war against the Federation.<\/p>\n<h3 id='international-reactions'  id=\"boomdevs_4\">International reactions&nbsp;<\/h3>\n<p class=\"p1\">However,&nbsp;the latest developments are also creating increasing headaches beyond national borders. &#8220;<strong>The EU is concerned about Ukraine&#8217;s recent actions against its anti-corruption institutions<\/strong>,&#8221; Mercier recalled, reiterating that &#8220;Ukraine&#8217;s accession to the EU will require a <strong>strong capacity to fight corruption and ensure institutional resilience<\/strong>.&#8221;<\/p>\n<p class=\"p1\">The <strong>ambassadors of the G7 members in Kyiv<\/strong> also expressed &#8220;<strong>serious concern<\/strong>&#8220;, declaring their &#8220;willingness <strong>to <strong>discuss these developments with the government leadership<\/strong>&#8221; <\/strong>and reiterating their support &#8220;for transparency, independent institutions, and good governance&#8221; as well as continued work with Ukraine &#8220;<strong>to <strong>combat corruption<\/strong> together<\/strong>.&#8221;<\/p>\n<p class=\"p1\">In fact, the internal clash appears to be only just beginning, raising a fundamental question about the <strong>solidity of Ukrainian democracy<\/strong> after three and a half years of resistance to the Russian invasion. <strong>A<\/strong>&nbsp;<strong>new round of talks in Istanbul between delegations from Kyiv and Moscow <\/strong>is <a href=\"https:\/\/www.eunews.it\/en\/2025\/07\/22\/zelensky-announces-fresh-ukraine-russia-talks-in-istanbul\/\">scheduled<\/a> for tomorrow (23 July), although no one expects a decisive breakthrough in the ceasefire negotiations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The government in Kyiv is about to bring two independent anti-corruption bodies under its control, triggering reactions from civil society and international partners.
