{"id":439806,"date":"2025-11-10T19:29:15","date_gmt":"2025-11-10T18:29:15","guid":{"rendered":"https:\/\/www.eunews.it\/2025\/11\/10\/digitale-la-semplificazione-del-gdpr-fa-gli-interessi-delle-aziende-e-limita-la-privacy-degli-utenti\/"},"modified":"2025-11-11T16:03:25","modified_gmt":"2025-11-11T15:03:25","slug":"digital-data-gdpr-simplification-serves-corporate-interests-and-limits-user-privacy","status":"publish","type":"post","link":"https:\/\/www.eunews.it\/en\/2025\/11\/10\/digital-data-gdpr-simplification-serves-corporate-interests-and-limits-user-privacy\/","title":{"rendered":"Digital data, GDPR &#8220;simplification&#8221; serves corporate interests\u2014and limits user privacy"},"content":{"rendered":"<p>Brussels &#8211; In a desperate attempt to regain for European companies the&nbsp;<span style=\"margin: 0px;padding: 0px\">much-sought-after&nbsp;<strong>economic competitiveness<\/strong>&nbsp;lost to the United States and China, the EU Commission may be about to pummel one of the most important pieces of digital legislation: the&nbsp;<strong>General Data Protection Regulation<\/strong>, better known by its acronym,<\/span>&nbsp;<strong>GDPR<\/strong>.<\/p>\n<p>&nbsp;According to rumours circulating in the international press in the last few hours, the so-called &#8220;<strong>Digital Omnibus<\/strong>&#8221; that the EU executive <a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/14855-Simplification-digital-package-and-omnibus_en\" target=\"_blank\" rel=\"noopener\"><b>is expected to present in the coming weeks&nbsp;<\/b><\/a>would contain a series of proposals aimed at <strong>radically reforming the GDPR<\/strong>, hitherto hailed in Brussels as one of the most advanced legislations in the world in terms of protecting user privacy in the IT world.&nbsp;<\/p>\n<p>The push would come from none other than <strong>Mario Draghi<\/strong>. The GDPR,&nbsp;<span style=\"margin: 0px;padding: 0px\">adopted in 2016 and entered into force in 2018, was one of the targets of the&nbsp;<strong>European Competitiveness Report<\/strong>&nbsp;he<a href=\"https:\/\/www.eunews.it\/en\/2024\/09\/09\/von-der-leyen-presents-draghi-report-competitiveness-has-to-be-at-the-top-of-our-agenda-move-forward-with-the-clean-and-digital-transition\/\" target=\"_blank\">&nbsp;presented in September 2024<\/a><\/span>. Indeed, Draghi points to a <strong>20 per cent increase in&nbsp;<\/strong><span style=\"margin: 0px;padding: 0px\"><strong>data management costs for economic operators<\/strong>&nbsp;in the EU<\/span>. On this basis, he has repeatedly defended the need for a &#8220;<strong>radical simplification<\/strong>&#8221; of the regulation, as well as <strong>greater harmonisation<\/strong> at the implementation level.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">Given that <strong>industrial competitiveness<\/strong> is one of the Polar Stars of the&nbsp;<span style=\"margin: 0px;padding: 0px\"><a href=\"https:\/\/www.eunews.it\/en\/2025\/01\/29\/von-der-leyen-presents-the-competitiveness-compass-simplification-is-the-new-eu-watchword\/\" target=\"_blank\">&nbsp;Commission&#8217;s policy agenda<\/a>, the Berlaymont would set to work&nbsp;<strong>dismantling<\/strong><\/span>&nbsp;<strong>some central elements of the GDPR<\/strong> to make life easier for developers. The aim is to foster the Union&#8217;s emergence as a global hub of artificial intelligence, according to a <strong>twelve-star deregulation strategy<\/strong> <a href=\"https:\/\/www.eunews.it\/en\/2025\/02\/11\/von-der-leyens-european-way-to-artificial-intelligence\/\" target=\"_blank\" rel=\"noopener\">announced months ago<\/a> by <strong>Ursula von der Leyen<\/strong> herself.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">In the race for global hegemony in this critical area, to which <a href=\"https:\/\/www.eunews.it\/en\/2025\/04\/09\/eu-plans-to-build-five-gigafactories-to-develop-cutting-edge-artificial-intelligence-models\/\" target=\"_blank\" rel=\"noopener\">Brussels wants to participate<\/a> building a <strong>series of AI Gigafactories<\/strong> where to train &#8220;Made in Europe&#8221; AI models (<br \/>\nan initiative that seems to have attracted the <a href=\"https:\/\/www.eunews.it\/en\/2025\/06\/30\/artificial-intelligence-european-gigafactories-attract-industrys-interest\/\">interest of the industry<\/a>), the new gold of the 21st century is <strong>user data<\/strong>, collected in huge quantities by digital platforms and various services under the pretext of providing a more efficient and personalised experience.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">The Commission would thus be <strong>making&nbsp;<\/strong><span style=\"margin: 0px;padding: 0px\"><strong>it easier&nbsp;for digital giants to access data<\/strong><\/span>&nbsp;by scaling back the rules set by EU lawmakers to protect the citizens of the Twenty-Seven. Among the first sections of the GDPR to come under the axe of simplification would be that relating to the concept of &#8220;<strong>legitimate interest<\/strong>&#8220;. Under the current rules, companies are obliged to&nbsp;<span style=\"margin: 0px;padding: 0px\"><strong>obtain users&#8217; explicit consent<\/strong>&nbsp;to collect their data, unless they can demonstrate a legitimate interest to justify a form<\/span>&nbsp;of &#8220;<strong>trawling<\/strong>&#8220;. The amendments prepared by the EU executive would go in the direction of precisely widening the scope of this legal basis, allowing companies to access a <strong>much larger<\/strong> <strong>quantity of information<\/strong> (without having to ask for permission).<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">Recent updates from giants such as Meta and Google, and from platforms such as X and LinkedIn, are going precisely in this direction. For instance,<span style=\"margin: 0px;padding: 0px\"><strong>&nbsp;setting, by default, a prior consent<\/strong>&nbsp;from users for<\/span>&nbsp;the <strong>use of the data contained in their posts<\/strong> for the training of their respective artificial intelligences. One in which, if only on the surface, <strong>technological progress<\/strong> and protection of <strong>basic rights<\/strong> are pitted against each other. On the one hand, the <strong>profitability of the tech giants<\/strong> (which to date remain mainly US-based) and the <strong>attractiveness of European markets<\/strong> in the digital age. On the other hand, adherence to the&nbsp;<span style=\"margin: 0px;padding: 0px\"><strong>EU&#8217;s constituent values<\/strong>, including respect for <strong>citizens&#8217;<\/strong>&nbsp;<strong>privacy<\/strong><\/span>.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">Yet, <a href=\"https:\/\/fpf.org\/blog\/the-draghi-dilemma-the-right-and-the-wrong-way-to-undertake-gdpr-reform\/\" target=\"_blank\" rel=\"noopener\">some industry experts<\/a> argue, there are different ways to reform the GDPR. While it is true that a number of improvements can be made through targeted interventions, it is equally true that <strong>sacrificing user protection on the altar of unbureaucratisation<\/strong>\u2014for the almost exclusive benefit of a small number of private companies\u2014risks producing <strong>consequences that are difficult to foresee<\/strong>.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">In catching up with Washington and Beijing, critics of this approach argue, perhaps Brussels should remember what distinguishes the Union from its main global competitors. Namely, the much-proclaimed <strong>social market economy<\/strong>, where higher ethical considerations should come before pure economic gain and efficiency. To proceed in the direction suggested by the amendments in question, they warn, would amount to an unconditional <strong>surrender to the private interests<\/strong> of the IT giants.&nbsp;<\/p>\n<p style=\"margin-bottom: 0px\"><\/p>\n<p style=\"margin-bottom: 0px\">However, as happened with the previous Omnibus packages presented by the Berlaymont, this one too will have to <strong>go through the scrutiny of the co-legislators<\/strong>\u2014the European Parliament&nbsp;and the EU Council. Where, in all likelihood, we will witness a <strong>heated political clash<\/strong> between those in favour of simplification and those who want nothing to do with reopening the GDPR.<\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the name of competitiveness, the European Commission is reportedly about to dismantle the Data Protection Regulation in force since 2018, proudly flaunted as a global regulatory standard.
