Strange, yet true. Vinted, the popular Lithuanian website for buying and selling second-hand items that are no longer worn, is a peer-to-peer marketplace. It is not companies selling to consumers, but private individuals selling items in their wardrobes to one another. <\/p>\n<p><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\"><span lang=\"it\" class=\"HwtZe\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\"><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">From the European Parliament, however, MEP <strong>Dirk Gotink<\/strong> (EPP)&nbsp;<span lang=\"it\" class=\"HwtZe\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\"><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\"><a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/E-10-2026-000292_EN.html\" target=\"_blank\" rel=\"noopener\">denounces<\/a>:&nbsp;<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span>&#8220;M<strong>uch of the clothing offered for sale as second-hand designer clothing on the popular website Vinted is in fact counterfeit fast fashion originating from Chinese platforms such as Shein.<\/strong>&#8220;<span lang=\"it\" class=\"HwtZe\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">\u200b\u200b\u200b<\/span><\/span><\/span> The Commission takes note, but can do little or nothing.&nbsp;<span lang=\"it\" class=\"HwtZe\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Executive Vice-President for Technological Sovereignty, <strong>Henna Virkkunen<\/strong>, points out that t<\/span><\/span><\/span>he <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2005\/29\/oj\/eng\" target=\"_blank\" rel=\"noopener\">directive on unfair business-to-consumer commercial practices<\/a>&nbsp;prohibits traders from misleading consumers with false information about the product being sold, but the directive itself &#8220;applies only to business-to-consumer<br \/>\ntransactions and therefore <strong>does not apply to transactions concluded solely between<br \/>\nconsumers, which may occur on platforms such as Vinted<\/strong> when the seller acts as a private<br \/>\nindividual.&#8221;<\/span><\/span><\/span>&nbsp;<\/p>\n<p>So, Brussels acknowledges that it is possible to sell products on Vinted that do not originate from private individuals. In this specific case, one cannot even invoke the <strong>Digital Services Act<\/strong> (DSA), since, as things stand,&nbsp;<strong>&#8220;Vinted is not designated as a very large online platform,&#8221;&nbsp;<\/strong>as Virkkunen points out again in her response to the parliamentary question. This means that<strong> Vinted does not reach 45 million users per month<\/strong>, and this does not trigger European Commission controls, which remain at the national level. Not individual Member States, mind you: in this specific case, the Executive Vice-President of the European Commission clarifies further, &#8220;<span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">the Member state in which its main establishment is located in the<br \/>\nEU is competent to supervise and enforce the DSA against it.&#8221; <strong>It is therefore up to Lithuania to prevent Shein from circumventing EU rules via Vinted<\/strong>.<\/p>\n<p><\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The rules on e-commerce do not apply to platforms where users buy and sell clothing, and companies such as Shein are reportedly taking advantage of this.
