The Council of Europe\u2019s <a href=\"https:\/\/www.coe.int\/en\/web\/cpt\/home\" target=\"_blank\" rel=\"noopener\"><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Committee for the Prevention of Torture<\/span><\/span><\/span><\/a>&nbsp;(CPT) has sounded the alarm: the situation is deteriorating both inside and outside prisons, with <strong>Italy coming under scrutiny<\/strong>. The <a href=\"https:\/\/rm.coe.int\/48802b585f\" target=\"_blank\" rel=\"noopener\">2025 annual report<\/a>&nbsp;was drawn up following visits by the delegation from the international organization to prisons in Avellino, Foggia, Florence Sollicciano, Genoa Marassi, and Santa Maria Capua Vetere (Caserta). Although there is no specific country report and no direct references, a general picture is painted that inevitably includes Italy.<\/p>\n<p>&nbsp;<span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">&#8220;The Committee for the Prevention of Torture <strong>continues to report allegations of physical ill-treatment by<br \/>\nlaw-enforcement personnel, especially upon apprehension and during informal questioning,<\/strong>&#8221; states the over 90-page document.<\/span><\/span> It is&nbsp;noted here that abuses also occur during the pre-trial phase. &#8220;<span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Claims of excessive use of force and verbal abuse or insults are also frequently made to<br \/>\nCPT delegations.&#8221;&nbsp;<\/span><\/span><\/span>From this perspective, <span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">the CPT noted<strong>&nbsp;&#8220;worrying signs across Europe, where ill-treatment has<br \/>\nbegun to re-emerge,<\/strong>&#8221; contrary to what was recorded in previous years.<\/span><\/span><\/span>&nbsp;<\/p>\n<p><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">In the report, the committee also expresses &#8220;<strong>concern regarding pre-trial detention and maximum-security regimes.<\/strong>&#8220;<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">In several countries, prisoners awaiting trial are often confined to their cells for over 22 hours a day, in a situation that can last for months, proving \u201cparticularly harmful.\u201d<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">While acknowledging &#8220;the challenges posed by organized crime&#8221;, the Committee nevertheless emphasizes &#8220;the need to ensure adequate safeguards and controls&#8221; to prevent maximum security regimes from resulting in de facto isolation and excessive restrictions.<\/span><\/span><\/span><\/p>\n<p>&nbsp;https:\/\/www.eunews.it\/2025\/05\/05\/carceri-sovraffollamento-ue-italia\/<\/p>\n<h4 id='unidentifiable-officers-and-the-issue-of-impunity'  id=\"boomdevs_1\">Unidentifiable officers and the issue of impunity<\/h4>\n<p style=\"margin-bottom: 0px\">\n<p>The resurgence of physical and verbal violence against people in custody is due to a general weakening of safeguards for those who end up in handcuffs and behind bars. The Council of Europe Committee reports that &#8220;<span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">the effectiveness of a number of oversight mechanisms diminished and<br \/>\n<strong>a sense of impunity for abusive actions pervades\u200b.<\/strong>&#8221; This has led to new calls for &#8220;a means<br \/>\nof visible identification of officers and the establishment of robust complaint mechanisms.&#8221; One suggestion is the use of internal video surveillance systems, together with body-worn cameras, as preventive security measures.<\/span><\/span><\/span><\/p>\n<p style=\"margin-bottom: 0px\">\n<p><\/p>\n<h4 id='prison-overcrowding-a-factor-that-does-not-help'  id=\"boomdevs_2\">Prison overcrowding: a factor that does not help<\/h4>\n<p style=\"margin-bottom: 0px\">\n<p><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The phenomenon of physical and verbal violence&nbsp;results from two distinct issues: the loss of institutional control, &#8220;combined with inadequate infrastructure.&#8221; Essentially, this means that &#8220;in<br \/>\nprisons, overcrowding is undermining the operation of these complex establishments and<br \/>\nsolutions must be found, otherwise <strong>the risk of the wider criminal justice system failing<\/strong> will<br \/>\nincrease&#8221;.<\/span><\/span> According to the Council of Europe\u2019s Committee for the Prevention of Torture, \u201ci<span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">nsufficient staffing, and lack of appropriate training are also major weaknesses,<br \/>\ncreating additional pressure on already unstable environments.\u201d<\/span><\/span><\/span><\/p>\n<p style=\"margin-bottom: 0px\"><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Overcrowding, it is reported, not only compromises the functioning of prisons and potentially exposes individuals to inhuman and degrading treatment, but also encourages criminal activity within the prison, <strong>&nbsp;<\/strong>corrodes staff-prisoner relations, and<strong>&nbsp;&#8220;increases<br \/>\nthe risk of violence<\/strong>, tension, and deterioration in mental health for both prisoners and<br \/>\nstaff alike.&#8221;<strong><\/strong><\/span><\/span><\/span><\/p>\n<p style=\"margin-bottom: 0px\"><span class=\"HwtZe\" lang=\"it\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">&nbsp;In this context, the international body further notes, \u201cthe renewed willingness of governments in recent years to&nbsp;externalize detention to other countries&nbsp;will be followed with attention.\u201d<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"it\">In light of this situation, &#8220;<strong>governments should show political will <\/strong>and take resolute measures to eradicate prison overcrowding and ensure respect for the human dignity of individuals in detention, including appropriate regime, care and living conditions,<span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">&#8221; said&nbsp;<strong>Alan Mitchell<\/strong>, Chair of the Council of Europe\u2019s Committee for the Prevention of Torture.<\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Committee for the Prevention of Torture has also called out Italy: &#8220;The situation is worrying across Europe, with abuses occurring particularly at the time of arrest and during informal interrogations.
