This was established by the Court of Justice of the EU in a <a href=\"https:\/\/infocuria.curia.europa.eu\/tabs\/jurisprudence?sort=DOC_DATE-DESC&amp;searchTerm=%22C-722%2F23%22&amp;publishedId=C-722%2F23\" target=\"_blank\" rel=\"noopener\">judgment.<\/a> A country may decide not to transfer a convicted person if it considers that the transfer could result in inhuman or degrading prison conditions. However, the national authority that decides not to execute the European arrest warrant \u201cis required actively to seek to ensure that the <strong>requested person does not go unpunished <\/strong>as a result of that<br \/>\nrefusal,\u201d and, therefore, the judges in Luxembourg explain, it is necessary to \u201c<strong>ensure that sentences are enforced within its own territory.<\/strong>\u201d&nbsp;<\/p>\n<p>The Court\u2019s decision broadens the scope of the case law in this area.
