This is the message contained in the <a href=\"https:\/\/www.coe.int\/en\/web\/commissioner\/-\/austria-denmark-germany-greece-and-the-netherlands-should-put-in-place-strict-human-rights-guardrails-in-their-plans-for-return-hubs-?fbclid=IwY2xjawTFendleHRuA2FlbQIxMABicmlkETBLNE90VTNrZDlhcmZQVzh3c3J0YwZhcHBfaWQQMjIyMDM5MTc4ODIwMDg5MgABHs__uHmjBDdPc8Q3Fq8pnLnddePs4XHjd3zZszkb2SYVeCR_64l91HZ9RCvd_aem_aL6opa4SDYQsvLX1HUfpag\" target=\"_blank\" rel=\"noopener\">letters<\/a> sent on 8 July by the Council of Europe\u2019s Commissioner for Human Rights, <strong>Michael O\u2019Flaherty<\/strong>, to the ministers responsible for migration policy in Austria, Denmark, Germany, Greece and the Netherlands. The reason is that the five governments have expressed their intention to <a href=\"https:\/\/rm.coe.int\/letter-to-the-federal-minister-of-the-interior-of-austria-by-michael-o\/48802c7faa\" target=\"_blank\" rel=\"noopener\">work together<\/a> to establish repatriation hubs&nbsp;outside the European Union, with the initiatives ideally to be \u201cfinalised\u201d by the end of 2026 so that they can move on to \u201cimplementation in 2027.\u201d&nbsp;<\/p>\n<p>As early as September 2025, in the conclusions of his report &#8220;<a href=\"https:\/\/rm.coe.int\/report-on-externalisation-of-migration-by-michael-o-flaherty-council-o\/488028300a\" target=\"_blank\" rel=\"noopener\" style=\"cursor: pointer !important\">Externalised asylum and migration policies and international human rights law<\/a>&#8220;, O\u2019Flaherty had emphasised that \u201csending people to repatriation hubs&nbsp;would entail significant risks to human rights.\u201d For this reason, the Commissioner proposed including four fundamental &#8220;safeguards&#8221; in the plans for the repatriation hubs.&nbsp;<\/p>\n<p><strong>First and foremost, before any initiative to establish repatriation hubs, there should be a comprehensive assessment of the direct and indirect risks to human rights<\/strong>.<strong> <\/strong>This should be based on a \u201crigorous analysis of the facts and the law\u201d and set out a plan to \u201cprevent, mitigate or remedy such risks.\u201d&nbsp;Member States should also <strong>ensure that return hubs&nbsp;are subject to <\/strong> \u201c<strong>adequate, independent and continuous human rights monitoring<\/strong>, with robust review and suspension mechanisms.\u201d Thirdly, cooperation between states on this issue should also be based on legally binding agreements that include enforceable human rights clauses.&nbsp;The final safeguard is to ensure \u201cparliamentary, public, and judicial oversight\u201d by making \u201crisk assessments, mitigation plans, monitoring results and agreements\u201d publicly available.&nbsp;<\/p>\n<p>As of today (16 July), <strong><\/strong><a href=\"https:\/\/rm.coe.int\/reply-of-the-minister-of-the-interior-of-austria-to-the-commissioner-s\/48802c8e9f\" target=\"_blank\" rel=\"noopener\">Austria<\/a><strong><\/strong>, <strong><\/strong><a href=\"https:\/\/rm.coe.int\/reply-of-the-federal-minister-of-the-interior-of-germany-to-the-commis\/48802c8dc4\" target=\"_blank\" rel=\"noopener\" style=\"cursor: pointer !important\">Germany<\/a>, <strong><\/strong><a href=\"https:\/\/rm.coe.int\/reply-by-the-minister-of-migration-and-asylum-of-greece-to-the-commiss\/48802c8e3f\" target=\"_blank\" rel=\"noopener\">Greece<\/a>, and <strong><a href=\"https:\/\/rm.coe.int\/comments-from-the-dutch-minister-of-asylum-and-migration-to-the-commis\/48802c8bf3\" target=\"_blank\" rel=\"noopener\">the Netherlands<\/a><\/strong> have replied to the Commissioner, thanking him for his letter, reaffirming their commitment to implementing migration policies fully in line with international and EU law, and stating that it is&nbsp;\u201cessential\u201d that the design and operation of return hubs&nbsp;comply with these international and EU standards. Return hubs&nbsp;are facilities that EU Member States may establish in third countries. According to the EU institutions, \u201cthey <a href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/BRIE\/2026\/789344\/EPRS_BRI(2026)789344_EN.pdf\" target=\"_blank\" rel=\"noopener\">are used <\/a>to house irregular migrants who do not have the right to remain in the EU.\u201d In reality, the actual terms are harsher than this.&nbsp;Under the new <strong><\/strong><a href=\"https:\/\/www.eunews.it\/en\/2026\/06\/17\/parliament-gives-the-green-light-to-the-return-regulation-the-peoples-party-and-the-far-right-join-forces\/\">provisions set out in the Returns Regulation<\/a><strong><\/strong>, anyone subject to a return order is obliged to leave European territory and to cooperate with the authorities. Failure to do so may result in detention for up to 24 months, with the possibility of an extension. Furthermore, the regulation opens up the possibility of transferring migrants to hubs&nbsp;located outside the EU, in third countries willing to receive them on the basis of bilateral agreements, modelled on the <strong><\/strong>Italian hubs&nbsp;in Albania<strong><\/strong>. However, the Advocate General of the Court of Justice of the European Union has already raised objections to the latter, stating that, although it is possible for a country to conclude bilateral agreements on asylum only in those areas not already &#8220;harmonised&#8221; by EU law, the Protocol between Italy and Albania and the national implementing legislation do not appear to contain clear and precise provisions capable of guaranteeing the full range of rights.
