The proposal to reorganise the national port system currently being considered by the Meloni government has prompted warnings from the European Commission, which \u201cis in contact with the Italian authorities on the matter\u201d, according to the <a href=\"https:\/\/www.eunews.it\/en\/2024\/09\/17\/von-der-leyen-unveils-new-college-of-commissioners-six-executive-vice-presidents-fitto-for-reforms-and-cohesion\/\" target=\"_blank\" rel=\"noopener\">Executive Vice-President responsible for Competition<\/a>, <strong>Teresa Ribera<\/strong>.&nbsp;This means that Rome and Brussels are working together to ensure that the reorganisation of Italy\u2019s ports proceeds not only smoothly but also in a way that secures the EU\u2019s approval once the legislative process has been completed. <\/p>\n<p>The national reform has sparked a backlash from the opposition at the European level, where the PD MEP, <strong>Brando Benifei<\/strong>,<a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/P-10-2026-002939_IT.html\" target=\"_blank\" rel=\"noopener\"> raises doubts<\/a> regarding Porti d\u2019Italia S.p.A., the new centralised body responsible for managing the Italian port system, to which, according to the draft proposal, a share of the revenue currently collected by the Port System Authorities would be transferred, including revenue from mooring fees, cargo levies,&nbsp;and concession fees.&nbsp;<\/p>\n<p>It is here that Ribera makes clear the extent of the European Commission&#8217;s contact with the Meloni government, specifying that the new port authority, Porti d\u2019Italia S.p.A., must act in accordance with the rules and case law. &nbsp;\u201cThe <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=ecli:ECLI%3AEU%3AT%3A2023%3A862\" target=\"_blank\" rel=\"noopener\">Court of Justice judgment of 2023,&nbsp;<\/a>where the Court confirmed the Commission\u2019s<br \/>\nrequirement that Italy align the port authorities\u2019 tax treatment to that of other companies<br \/>\nperforming economic activities, is relevant in this context,&#8221; she said.<\/p>\n<p>Whatever the final form of the reform of Italian ports may take, the Meloni government will have to meet this requirement. However, the executive vice-president points out that the judges in Luxembourg have also ruled that \u201cgranting access to port infrastructures and concessions for the use of land and port<br \/>\ninfrastructures against remuneration qualifies as economic activities\u201d.&nbsp;This criterion cannot be ignored, or future infringement proceedings will follow.
