The plan had been submitted by Temu in August 2026 after an analysis carried out by the Berlaymont Building had identified the presence of “non-compliant’” children’s toys and electronic gadgets.

The roadmap is structured around five “corrective measures”. The first is carrying out a risk assessment tailored to its service, using reliable and up-to-date information to identify the specific risks associated with the design, operation, and use of the platform. The second is the examination of reliable metrics and indicators to assess whether and how the mitigation measures put in place are effective in reducing the risk of the dissemination of illegal content. Next, the assessment of possible limitations and shortcomings of the content moderation system and their impact on recommended products, taking into account the design and operation of the system, including the platform’s moderation policies and rules, automated detection tools, manual review, and much more. In addition, there is an analysis of how algorithmic systems may influence and potentially amplify the spread of illegal content on its marketplace, based on relevant and reliable metrics. Finally, a comprehensive examination of the role of intentional manipulation of the service and the potentially rapid and widespread dissemination of illegal content, including an analysis of how professionals and other users of the service may exploit Temu’s features to disseminate listings of illegal goods.

The Digital Services Committee – an independent advisory group set up by the DSA – was consulted on these measures and issued an opinion on 24 September. Initially, it had deemed the amendments to be “partially adequate”, stating that “they lacked sufficient detail to fully assess whether they adequately addressed the infringement.” Subsequently, the Berlaymont Building took the committee’s opinion into account, clarifying the key requirements that Temu needed to incorporate into its plan. Temu now has four months to implement the plan. Should an auditor identify any recommendations to be incorporated, the Chinese platform will have one month to report to the European Commission on their implementation.

In July 2025, the Commission had published preliminary findings regarding the giant which indicated a suspicion that Temu was in breach of Article 34 of the DSA with regard to the assessment of systemic risks associated with illegal products circulating on its marketplace.
