    New probe into X and Grok over suspected breaches of rules against child sexual abuse materials

    The European Commission has opened a new case against Elon Musk's social media platform, which is alleged to be in breach of the Digital Services Act by failing to combat illegal content. The investigation, which began in December 2023, is continuing.

    Brussels – The European Commission puts Elon Musk back in the spotlight: the EU executive has decided to launch a new investigation into X to verify whether Musk’s platform may have violated the Digital Services Act (DSA). Specifically, according to Brussels, the investigation will assess whether the company properly assessed and mitigated risks associated with deploying Grok’s functionalities into X in the EU. This includes risks related to the dissemination of illegal content in the EU, such as manipulated sexually explicit images, including content that may amount to child sexual abuse material.

    “These risks appear to have materialised, exposing EU citizens to serious harm,” the EU executive said in the statement accompanying the decision to launch the investigation, the aim of which is precisely to dispel these doubts. For this reason, X is asked “to conduct and transmit to the Commission” an ad hoc risk assessment report for Grok’s functionalities in the X service with a critical impact on X’s risk profile prior to their deployment.

    With this investigation, we will determine whether X has met its legal obligations under the DSA, or whether it treated rights of European citizens – including those of women and children – as collateral damage of its service,” said Executive Vice-President for Technological Sovereignty, Henna Virkkunen.

    That’s not the end of the bad news for Elon Musk and his social media channel because in addition to launching new investigations, the Commission has extended the ongoing formal proceedings initiated against X in December 2023 to determine whether X has adequately assessed and mitigated all systemic risks, as defined in the DSA, associated with its recommendation systems, including the impact of its recently announced transition to a Grok-based recommendation system.
